MUNICIPAL CHARTERS

and corporate known by the name of "The Commissioners of
Charlestown", said amendment to set forth procedures by
which the town may take certain properties within
municipal boundaries for which there is an immediate
need.

Section 1. Be it resolved by the Board of
Commissioners of Charlestown, Maryland that a new Section
25—19 of the Charter of the Town of Charlestown be added
to read as follows:

SECTION 25-19. IMMEDIATE TAKING OF PROPERTY

WHERE, IN THE JUDGMENT OF AND UPON A FINDING BY THE
COMMISSIONERS OF CHARLESTOWN, THERE IS IMMEDIATE NEED FOR
CERTAIN PROPERTY FOR RIGHTS-OF-WAY FOR MUNICIPAL ROADS,
STREETS OR EXTENSION OF MUNICIPAL MATER AND SEWAGE
FACILITIES, SUCH PROPERTY MAY BE TAKEN IMMEDIATELY UPON
PAYMENT THEREFOR TO THE OWNER OR OWNERS THEREOF, OR INTO
COURT, SUCH AMOUNT AS A LICENSED REAL ESTATE BROKER
APPOINTED BY THE COMMISSIONERS OF CHARLESTOWN SHALL
ESTIMATE TO BE A FAIR MARKET VALUE OF SUCH PROPERTY,
PROVIDED THAT THE TOWN OF CHARLESTOWN SHALL SECURE THE
PAYMENT OF ANY FURTHER SUM THAT SUBSEQUENTLY MAY BE
AWARDED BY A JURY AS PROVIDED FOR AND IN ACCORDANCE WITH
ARTICLE III, SECTION 40A OF THE MARYLAND CONSTITUTION.
THIS SECTION SHALL NOT APPLY IF THE PROPERTY ACTUALLY TO
BE TAKEN INCLUDES A BUILDING OR BUILDINGS.

Section 2. And be it further resolved that the
amendments proposed in this Resolution shall become and
be considered a part of the Charter of the Town of
Charlestown according to the terms of the amendments, in
all respects to be effective and observed as such, upon
July 31, 1974 unless on or before July 21, 1974 there
shall be presented to the Board of Commissioners a proper
petition for referendum as permitted by law.

Section 3. And be it further resolved that the
President of the Board of Commissioners of the Town of
Charlestown be, and he is hereby specifically directed to
post a complete and exact copy of this Resolution at the
Town Hall or other main municipal building or public
place for a period of forty days following its adoption
by the Board of Commissioners and to cause a fair summary
of the proposed amendments to be published in a newspaper
of general circulation in the town not less than four
times, at weekly intervals, within a period of at least
forty days after adoption of this Resolution.

Section 4. And be it further resolved that as soon
as the charter amendment hereby proposed shall become
effective either as herein provided or following a
referendum, the President of the Board of Commissioners
