become and be considered a part of the charter according
to the terms of the amendment to be effective and
observed as such on the 15th day of May, 1974, which is
at least fifty days after date of this Resolution, and
said amendment will be applicable, nunc pro tunc, to the
terms of the Mayor and Council elected to office on May
6, 1974.

RESOLUTION 74-9

TO EXTEND AND INCREASE THE CORPORATE LIMITS OF THE
TOWN OF CAPITOL HEIGHTS, COUNTY OF PRINCE GEORGE'S,
STATE OF MARYLAND, ANNEXING THERETO A CERTAIN TRACT
OF LAND CONTIGUOUS TO AND NOT EMBRACED WITHIN THE
PRESENT LIMITS OF THE TOWN OF CAPITOL HEIGHTS

WHEREAS, The Town of Capitol Heights, Maryland, a
municipal corporation, is desirous of enlarging and
adding to the corporate boundaries thereof certain land
which is contiguous and adjoining to the existing
corporate area, and

WHEREAS, The Mayor and Common Council of the Town of
Capitol Heights, by Agreement with Charles E. Reithmeyer
and Grace M. Reithmeyer, his wife, sole owners of
certain hereinafter described tract of unimproved real
property contiguous and adjoining the present boundaries
of the corporate limits of the Town of Capitol Heights,
have determined to annex said real property to the lands
included within the corporate limits of said Town, and

WHEREAS, The owner and sole resident within the area
of the said land to be annexed, Charles E. Reithmeyer and
Grace H. Reithmeyer, his wife, has by agreement proposed
to the Town of Capitol Heights, Maryland, that said land
be annexed subject to certain stated conditions, namely,

(a)   that the Town will do no act either directly or
indirectly, which will interfere, impede or jeopardize
the Landowner's Landfill permit in the area to annexed,

(b)  that the Town will exempt said land from taxes of any
kind in connection with said land area to be annexed
until such time as the Town shall provide municipal
services to said area as designated hereinafter, and (c)
that the Town will furnish its support and approbation to
any application by Landowner for rezoning of the land
within the area to be annexed when and if said
applications are filed hereafter, and

WHEREAS, The Town of Capitol Heights and Charles E.
Reithmeyer, Landowner and sole resident, deem said
