MUNICIPAL CHARTERS

following the adoption of this Resolution, in compliance
with the provisions of Article 23A, Section 13 of the
Annotated Code of Maryland (1957 Edition and its
Supplements).

Adopted February 12, 1974.

A RESOLUTION TO REPEAL AND RE-ENACT WITH AMENDMENTS
SECTION 16-31. APPOINTMENT OF CERTAIN TOWN OFFICIALS. OF
ARTICLE III. MAYOR. OF CHAPTER 16. BRUNSWICK. OF THE
CODE OF THE COUNTY OF FREDERICK, MARYLAND, 1959 EDITION,
AS AMENDED, TO PROVIDE THAT THE CERTAIN TOWN OFFICIALS
NAMED IN SAID SECTION SHALL HOLD OFFICE FOR FOUR YEARS
AND UNTIL THE QUALIFICATION OF THEIR SUCCESSORS, RATHER
THAN FOR TWO YEARS.

That Section 16—31, of Article III. Mayor, of
Chapter 16. Brunswick, of the Code of the County of
Frederick, Maryland, 1959 Edition, as amended, be, and
the same is hereby, repealed in its entirety and
re—enacted with amendments so as to read as follows:

Section 16—31. Appointment of certain town
officials.

At the first regular meeting after each regular
election for mayor and after the qualification of the
newly elected members or as soon thereafter as may be
convenient, the mayor, with the advice and consent of the
council, shall appoint one person to be clerk, treasurer
and tax collector, one person to be attorney and counsel
to the mayor and council, one person to be general
superintendent, one person to be chief of police, one
person to be assistant chief of police, one person to be
town engineer and one person to be auditor, fall to be
chief of police, one person to be assistant chief of
police, one person to be town engineer and one person to
be auditor,] all of whom shall hold office for [two] FOUR
years and until the qualification of their successors.
The mayor, with the advice and consent of the council
shall appoint such other officers and committees as may
be required for the conduct and regulation of municipal
affairs, The mayor shall have the sole power of
appointments of all officers provided for in this
section, subject to the confirmation by a majority of all
the members elected to the council, which confirmation
shall not be later than the next regular meeting after
the receipt of such appointments. If the council fails to
take action within the stated time, then the person
nominated shall be to all intents and purposes such
officer as if he had been confirmed by the town council.
