BOONSBORO
SECTION 1, BE IT RESOLVED, By the Council of the
Mayor and Council of Boonsboro, that Section 3—4 of the
Charter of the Mayor and Council of Boonsboro, entitled
"Qualifications of Voters and town officers." as the same
appears in the Code of Public Local laws of Washington
County (1970 Ed.) be, and the same is hereby amended by
eliminating from said section that part thereof which is
hereinafter enclosed in double parentheses, and by adding
thereto the new matter which is typed in capital letters.
3-4. QUALIFICATIONS OF VOTERS AND TOWN OFFICERS.
The citizens of Boonsboro of the age of [twenty—one]
EIGHTEEN years and upwards who shall be first duly
registered as hereinafter prescribed shall on the second
Monday in May in the year [1942] NINETEEN HUNDRED SEVENTY
SIX, and not before, [and upon the same day every second
year thereafter,] elect by ballot a person, not under
twenty five years of age, a citizen of the United States
and a registered voter of the State of Maryland and three
years a resident of said town next preceding the election
to be Mayor of said town. He shall take the oath of
office as hereinafter prescribed for town officers, and
remain in office until his successor is elected and
qualified. At the same time and in the same manner there
shall also be elected five persons having the same
qualifications herein prescribed for the office of Mayor
to be Councilmen of Boonsboro, and also one person of
like qualification to be Assistant Mayor, THE MAYOR AND
THE TWO PERSONS RECEIVING THE HIGHEST NUMBER OF VOTES FOR
COUNCILMEN SHALL BE ELECTED AND SERVE FOR A TERM OF FOUR
TEARS AND UNTIL THEIR SUCCESSORS ARE ELECTED AND QUALIFY.
THE ASSISTANT MAYOR AND THE REMAINING THREE PERSONS
ELECTED FOR COUNCILMEN SHALL SERVE FOR A PERIOD OF TWO
YEARS AND UNTIL THEIR SUCCESSORS ARE ELECTED AND QUALIFY.
ON THE SECOND MONDAY IN MAY IN THE YEAR 1978, AND THE
SAME DAY EVERY FOURTH YEAR THEREAFTER, THE CITIZENS OF
BOONSBORO QUALIFIED TO VOTE SHALL ELECT AN ASSISTANT
MAYOR AND THREE PERSONS HAVING THE SAME QUALIFICATIONS
HEREIN PRESCRIBED FOR THE OFFICE OF MAYOR, TO BE
COUNCILMAN OF BOONSBORO AND TO SERVE FOR TERMS OF FOUR
YEARS OR UNTIL THEIR SUCCESSORS ARE DULY ELECTED AND
QUALIFY. ON THE SECOND MONDAY IN MAY IN THE YEAR 1980
AND UPON THE SAME DAY EVERY FOURTH YEAR THEREAFTER, THE
CITIZENS OF BOONSBORO QUALIFIED TO VOTE SHALL ELECT A
MAYOR, AND TWO COUNCILMEN ALL HAVING THE QUALIFICATIONS
HEREIN PRESCRIBED FOR THE OFFICE OF MAYOR AND ALL TO
SERVE FOR TERMS OF FOUR YEARS OR UNTIL THEIR SUCCESSORS
ARE DULY ELECTED AND QUALIFY. Provided that nothing in
this [act] AMENDMENT shall in any way affect the term,
powers or duties of the present Mayor, Assistant Mayor
and Councilmen of Boonsboro who were elected to their
respective offices on the second Monday in May [1940]
NINETEEN HUNDRED AND SEVENTY FOUR, for a term of two
