This bill provides that the Court of Appeals shall
require, by writ of certiorari, that a decision be
certified to it for review and determination in any case
in which a final judgment has been rendered by a circuit
court on appeal from the District Court under certain
conditions.

House Bill 796, which was enacted by the General
Assembly and signed by me on April 22, 1975, accomplishes
the same purpose.

Therefore it is unnecessary for me to sign Senate
Bill 849.

AN ACT concerning

Courts of Appeals — Jurisdiction

FOR the purpose of giving the Court of Special Appeals
jurisdiction over appeals from the Tax Court, and
expanding the Court of Appeals certiorari power.

Dear Mr. President:

In accordance with Article II, Section 17, of the
Maryland Constitution, I have today vetoed Senate Bill
850.

This bill amends the Courts and Judicial Proceedings
Article of the Annotated Code of Maryland, Sections
12-201 and 12—308(b) to provide for appeals from the
Maryland Tax Court to the Court of Special Appeals and
for review in the Court of Appeals by Petition for
Certiorari of cases pending or decided by the Court of
