WHOLE CONSTITUTES AN AREA HAVING SPECIAL SIGNIFICANCE FOR
THE POLITICAL, SOCIAL AND ARCHITECTURAL HERITAGE OF THE
STATE OF MARYLAND. THE STATE HAS UNDERTAKEN A BROAD
RANGE OF PROGRAMS, OFTEN INVOLVING THE EXPENDITURE OF
STATE FUNDS, TO PRESERVE AND ENHANCE THE CITY OF
ANNAPOLIS.

(B)    THE COUNCIL ON THE STATE CAPITAL IS CREATED TO
ACT PURSUANT TO THE AUTHORITY OF, AND WITH THE APPROVAL
OF, THE BOARD OF PUBLIC WORKS. THE MEMBERS OF THE
COUNCIL SHALL CONSIST OF THE SECRETARY OF THE DEPARTMENT
OF GENERAL SERVICES, THE SECRETARY OF THE DEPARTMENT OF
STATE PLANNING AND THE CHAIRMAN OF THE CAPITAL CITY
COMMISSION, ALL SERVING EX OFFICIO. THE BOARD OF PUBLIC
WORKS SHALL APPOINT ONE OF THE MEMBERS OF THE COUNCIL TO
ACT AS CHAIRMAN. THE COUNCIL SHALL MEET AT THE REQUEST
OF THE BOARD OF PUBLIC WORKS OR AT THE REQUEST OF THE
CHAIRMAN.

(C)    THE FUNCTIONS AND DUTIES OF THE COUNCIL ON THE
STATE CAPITAL SHALL BE:

(1) TO ADVISE AND MAKE RECOMMENDATIONS TO THE
BOARD OF PUBLIC WORKS ON THE IMPACT OF STATE PROGRAMS ON
THE CITY OF ANNAPOLIS AND ITS IMMEDIATE ENVIRONS AND HOW
THE BOARD OF PUBLIC WORKS MAY DIRECT THOSE PROGRAMS TO
PRESERVE AND ENHANCE THE CITY OF ANNAPOLIS.

[[(2) WITH THE APPROVAL OF THE BOARD OF
PUBLIC WORKS, TO ACT FOR THE STATE OR THE BOARD OF PUBLIC
WORKS IN THE ACQUISITION, MANAGEMENT, DISPOSITION OF REAL
PROPERTY, OR ANY INTEREST IN REAL PROPERTY, WHERE THE
PURPOSE OF THE STATE OWNERSHIP OF OTHER INTEREST IS TO
ENHANCE AND PROTECT THE CHARACTER OF THE CITY OF
ANNAPOLIS, INCLUDING ITS IMMEDIATE ENVIRONS.]]

[[(3)]] (2) TO SERVE AS THE REPRESENTATIVE OF
THE STATE, AND IN PLACE OF THE MARYLAND HISTORICAL TRUST,
WITH RESPECT TO THE LEASE BETWEEN THE MARYLAND HISTORICAL
TRUST AND HISTORIC ANNAPOLIS, INC., DATED FEBRUARY 21,
1969, PROVIDING FOR THE MANAGEMENT OF THE PACA HOUSE, AND
WITH RESPECT TO THE LEASE BETWEEN THE MARYLAND HISTORICAL
TRUST AND THE BOARD OF PUBLIC WORKS, AND HISTORIC
ANNAPOLIS, INC., DATED NOVEMBER 17, 1972, PROVIDING FOR
THE MANAGEMENT OF THE PACA GARDENS.

[[(4) AT THE REQUEST OF AND WITH THE APPROVAL
OF THE BOARD OF PUBLIC WORKS, TO ACT FOR THE STATE IN THE
MANAGEMENT OF ANY OTHER REAL PROPERTY, OR INTEREST IN
REAL PROPERTY, WITHIN THE CITY OF ANNAPOLIS, OR ITS
IMMEDIATE ENVIRONS.]]

[[(5)]] (3) AT THE DIRECTION OF THE BOARD OF
PUBLIC WORKS, SUPERVISE THE PREPARATION OF STUDIES,
