LAWS OF MARYLAND

[Ch. 612

COMPENSATION FOR HIS SERVICES BUT SHALL BE REIMBURSED FOR
NECESSARY TRAVEL EXPENSES AND DISBURSEMENTS MADE IN ORDER
TO ATTEND ANY MEETING OR PERFORM ANY OTHER DUTY.

(B) THE BOARD SHALL REVIEW ALL MATTERS AND
DOCUMENTS REFERRED TO IT INCLUDING:

(1)    EVERY PROPOSED DESIGNATION AS A WILD OR
SCENIC RIVER;

(2)    THE INVENTORY AND RIVERS AND RELATED
SHORELINES ELIGIBLE FOR INCLUSION INTO THE SYSTEM AS A
WILD OR SCENIC RIVER; AND

(3)    EVERY PROPOSED GUIDELINE AND RULE OR
REGULATION PRIOR TO ADOPTION.

8-406.

(A)    ANY CHANNEL, IMPOUNDMENT, DIVERSION, OR OTHER
OBSTRUCTION THAT WILL AFFECT THE FREE FLOWING NATURE OF A
WILD OR SCENIC RIVER INCLUDED IN THE SYSTEM REQUIRES THE
PRIOR APPROVAL OF THE DEPARTMENT. THE APPROVAL MAY NOT
BE GRANTED IF THE DEPARTMENT DETERMINES THE PROPOSED
CHANNEL, IMPOUNDMENT, DIVERSION, OR OTHER OBSTRUCTION IS
INCONSISTENT WITH ADOPTED GUIDELINES AND RULES AND
REGULATIONS OR WOULD ALTER THE CLASSIFICATION OF THE
RIVER UNLESS IT IS DEMONSTRATED THERE IS NO FEASIBLE
ALTERNATIVE TO THE PROPOSAL AND IT IS ESSENTIAL TO THE
GENERAL PUBLIC WELFARE.

(B)    MINING OF ANY MINERALS BY THE STRIP OR OPEN
PIT METHOD SHALL BE PROHIBITED IN THE SCENIC BUFFER ZONE
AND SCENIC CORRIDOR OF THE YOUGHIOGHENY RIVER. ANY MINING
PERMIT ISSUED PRIOR TO JULY 1, 1975 UNDER WHICH MINING
OPERATIONS ACTUALLY COMMENCED AS OF THAT DATE SHALL
EXPIRE ON JULY 1, 1976 UNLESS THE PERMIT TERMINATES
EARLIER PURSUANT TO THE PROVISIONS OF TITLE 7. THE
SCENIC BUFFER ZONE AND SCENIC CORRIDOR SHALL BE THAT
DESIGNATED BY THE SECRETARY IN THE BUREAU OF MINES
EMERGENCY REGULATIONS EFFECTIVE JANUARY 17, 1975 AS
PUBLISHED IN THE MARYLAND REGISTER.

8-407.

(A) A PERSON WHO PROPOSES ANY DEVELOPMENT OUTSIDE
OF A WILD OR SCENIC RIVER AND ITS RELATED SHORELINES
INCLUDED IN THE SYSTEM WHICH MIGHT ADVERSELY AFFECT THE
SCENIC, AESTHETIC, RECREATIONAL, GEOLOGIC, ECOLOGIC,
HISTORICAL, CULTURAL OR FISH AND WILDLIFE VALUES OF THE
RIVER SHALL GIVE FULL CONSIDERATION TO THESE VALUES AND
SHALL TAKE EVERY REASONABLE MEASURE TO MINIMIZE THE
ADVERSE IMPACT ON THE DEVELOPMENT OF THE WILD OR SCENIC
RIVER.
