OF EACH CLASSIFIED RIVER. THE DEPARTMENT MAY ADOPT RULES
AND REGULATIONS BEYOND THE 1000 FEET AVERAGE DISTANCE FOR
THOSE ADJACENT LAND AREAS WHICH ARE VISIBLE FROM THE
RIVER OR SHORE OF ANY WILD OR SCENIC RIVER AND FOR
ADJACENT AREAS WHERE DEVELOPMENT WOULD AFFECT THE
QUALITIES AND CHARACTERISTICS OF THE 1000 FEET ZONE. THE
POLICIES REFLECTED IN THE GUIDELINES AND RULES AND
REGULATIONS SHALL BE THAT WILD RIVERS ARE TO BE
MAINTAINED FREE OF SUBSTANTIAL EVIDENCE OF MAN'S
INTRUSION, AND SCENIC RIVERS ARE TO BE MAINTAINED TO
PROVIDE AESTHETIC ENJOYMENT AND RECREATIONAL
OPPORTUNITIES IN A NEAR NATURAL SETTING. THE GUIDELINES
AND REGULATIONS SHALL INCLUDE THE FOLLOWING:

(1)    PERMISSIBLE SHORELINE USES;

(2)    SET BACK REQUIREMENTS FOR ROADS, HOUSES,
AND OTHER STRUCTURES INCLUDING TRANSMISSION LINES,
UTILITY LINES AND PIPELINES;

(3)    REQUIREMENTS CONCERNING CUTTING OR
ALTERING TREES AND OTHER SHORELINE VEGETATION GIVING DUE
CONSIDERATION TO SELECTIVE CUTTING OF MATURE AND DEAD
TIMBER;

(4)    REQUIREMENTS CONCERNING ALTERING THE
NATURAL SHORELINE CONTOUR, OR OTHER NATURAL SOIL OR
GEOLOGIC FORMS;

(5)    REQUIREMENTS CONCERNING VISIBILITY OF
STRUCTURES FROM THE RIVER;

(6)    REQUIREMENTS CONCERNING NOISE LEVELS;

(7)    REQUIREMENTS CONCERNING SPECIAL STORM
WATER MANAGEMENT PROBLEMS WHICH MAY EXIST IN THE
WATERSHED OF A WILD OR SCENIC RIVER; AND

(8)    PROVISIONS FOR UPSTREAM STORM WATER
MANAGEMENT.

(B) THE REGULATIONS SHALL BE ADOPTED IN ACCORDANCE
WITH THE ADMINISTRATIVE PROCEDURE ACT AND IN ADDITION 60
DAYS NOTICE OF THE ADOPTION SHALL BE GIVEN TO EVERY
COUNTY AND LOCAL GOVERNMENT AFFECTED.

(A) A SCENIC RIVERS REVIEW BOARD IS CREATED AND
CONTINUED. THE BOARD CONSISTS OF THE SECRETARY OF THE
DEPARTMENT, THE SECRETARY OF THE DEPARTMENT OF STATE
PLANNING, AND THE CHAIRMAN OF THE MARYLAND ENVIRONMENTAL
TRUST. THE MEMBERS OF THE BOARD SHALL SELECT THE
CHAIRMAN. A MEMBER OF THE BOARD MAY NOT RECEIVE ANY
