AN ACT concerning

Air Quality Control - Emergency Variances

FOR the purpose of establishing certain procedures and
prerequisites for the issuance of temporary
variances necessitated by reason of an inability to
obtain the type of fuel required for compliance with
certain of the State's air quality control laws[[;
and authorizing the Department of Health and Mental
Hygiene to impose a variance fee as a condition to
the grant of these temporary variances]].

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 698A be and it is hereby added
to Article 43 - Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1974 Supplement) to read as
follows:

698A.

(A) THE STATE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE MAY UTILIZE THE PROCEDURES CONTAINED IN THIS
SECTION FOR THE PURPOSE OF GRANTING, ON A CASE-BY-CASE
BASIS, TEMPORARY VARIANCES FROM THE RULES, REGULATIONS,
AND ORDERS ADOPTED OR ISSUED UNDER THIS SUBTITLE, WHERE
IT FINDS THOSE TEMPORARY VARIANCES TO BE NECESSARY BY
REASON OF AN INABILITY TO OBTAIN THE TYPE OF FUEL
REQUIRED TO COMPLY WITH THESE RULES, REGULATIONS OR
ORDERS.
