(b) Minimizing dust or wind erosion; compliance
with silt control regulations. — Any person using
pozzolan for landfill, structural building, soil
improvement, agriculture, soil conditioning, or land
reclamation shall minimize dust or wind erosion and
comply with silt control regulations.]

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 7—464 be and it is hereby added to Article —
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1974 Supplement) to read as follows:

Article — Natural Resources

7-464. POZZOLAN.

(A)    DEFINITION.

IN THIS SECTION "POZZOLAN" MEANS THE FINELY DIVIDED
RESIDUE WHICH RESULTS FROM COMBUSTION OF GROUND OR
POWDERED COAL AND IS RELEASED BY COMBUSTION GASES, AS
DEFINED BY THE TEST METHODS PUBLISHED BY THE AMERICAN
SOCIETY FOR TESTING METHODS.

(B)    RESTRICTIONS ON PERMISSIBLE USES.

(1)    ANY PERSON WHO USES POZZOLAN FOR
LANDFILL SHALL DO SO IN A MANNER WHICH COMPLIES WITH
SOUND ENGINEERING PRACTICES AND PERMITS SUBSEQUENT
RECOVERY OF THE POZZOLAN.

(2)    ANY PERSON WHO USES POZZOLAN FOR
LANDFILL, STRUCTURAL BUILDING, SOIL IMPROVEMENT,
AGRICULTURE, SOIL CONDITIONING, OR LAND RECLAMATION SHALL
MINIMIZE DUST AND WIND EROSION AND SHALL COMPLY WITH ALL
SILT CONTROL REGULATIONS.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
