Clam Dredges — Restrictions and Prohibitions

FOR the purpose of requiring clam dredges to have
conveyor raised in restricted areas; prohibiting
oysters aboard clam dredge boats[[; and prohibiting
certain dredging of oyster bars]].

Article — Natural Resources
Section 4-1040 [[and 4-1102(e)]]
Annotated Code of Maryland
(1974 Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 4-1040 [[and 4-1102(e)]] be
and it is hereby added to Article — Natural Resources, of
the Annotated Code of Maryland (1974 Volume and 1974
Supplement) to read as follows:

Article — Natural Resources

4-1040.

(A)          A CLAM DREDGE IN OR CROSSING A RESTRICTED AREA
SHALL HAVE THE DREDGES'S CONVEYOR RAISED ABOVE THE
SURFACE OF THE WATER.

(B)           A PERSON MAY NOT HAVE ANY OYSTERS ABOARD A
CLAM DREDGE BOAT.

(E) THE USE OF CLAM DREDGES IS PROHIBITED FOR THE
PURPOSE OF SURVEYING OYSTER BARS TO DETERMINE THEIR
EXTENT OR THE QUANTITY OF OYSTERS ON THE BARS.]]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
