(a) Land for STATE highways, STREETS, ROADS,
schools and other public uses. The Commission [[is
authorized to]] MAY include in its annual budget
provision for the acquisition of lands[[,]] needed for
[arterial limited access highways] ANY [[EXISTING OR
PROPSED]] STATE HIGHWAYS, STREETS OR ROADS and for school
sites and other public uses [, except streets or roads
(other than such arterial limited access highways)]
[[IN]] [[MONTGOMERY COUNTY]] in Montgomery County. [[Any
such]] THE [arterial limited access] highway, STREET,
ROAD, school site, or other public use must be shown upon
the Commission's general plan for the physical
development of the Regional District OR AN ADOPTED PLAN
and each such acquisition shall have received the
approval by formal resolution of the District Council for
Montgomery County. [[Any such]] [arterial limited
access] [[highway, or]] A school site or other public
use, OTHER THAN A STATE HIGHWAY, STREET OR ROAD, may not
be within [[the]] [road construction program or other]
[[FIVE-YEAR HIGHWAY IMPROVEMENT PROGRAM WITH PONDS
ALLOCATED FOR SUCH ACQUISITION WITHIN THE CURRENT OR NEXT
SUCCEEDING FISCAL YEAR or WITHIN ANY other]] A public
construction program current at the time of acquisition.
No school site [[shall]] MAY be acquired under the terms
of this section without the prior approval of the
Montgomery County Board of Education.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
