SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 43 (a) and (e) of Article 40 -
General Assembly, of the Annotated Code of Maryland (1971
Replacement Volume and 1974 Supplement) be and they are
hereby repealed and re—enacted, with amendments, to read
as follows:
Article 40 - General Assembly
43.
(a) Any member of the General Assembly may request
the introduction of any bill or joint resolution in the
General Assembly by prefiling the bill or joint
resolution with the State Department of Legislative
Reference in advance of any regular session of the
General Assembly as provided in this section. The
request shall be made by the member in writing to the
Department stating the sponsors of the bill and enclosing
an outline or summary of the bill or joint resolution to
be prefiled. Such a request shall not be made in any
year in which an election for members of the General
Assembly is held, UNLESS MADE BY A MEMBER-ELECT OF THE
GENERAL ASSEMBLY NO EARLIER THAN FIVE DAYS AFTER THE
ELECTION. The request shall constitute the authority for
the Department to prefile the bill or joint resolution
for introduction.
(e) IN YEARS OTHER THAN THOSE IN WHICH AN ELECTION
FOR MEMBERS OF THE GENERAL ASSEMBLY IS HELD, THE [The]
final date for requesting the preparation of a prefiled
bill by the Department [shall be] IS November 15 prior to
any regular session of the General Assembly, and not
later than November 25 the member shall indicate if he
wishes to prefile the bill. IN AN ELECTION YEAR, THE
INITIAL AND FINAL DATES FOR A PREFILED BILL PREPARATION
REQUEST ARE FIVE DAYS AFTER THE ELECTION AND DECEMBER 1,
RESPECTIVELY, AND SUCH BILLS MAY BE PREFILED ONLY IF A
MEMBER-ELECT EXPRESSES THAT INTENTION NO LATER THAN
DECEMBER 1.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
