SECTION 1. BE IT ENACTED, BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 6-107[[(d)]] of Article -
Agriculture, of the Annotated Code of Maryland (1974
Volume and 1974 Supplement) be and it is hereby repealed
and re—enacted, with amendments, to read as follows:

Article — Agriculture

6-107.

(a) A person shall register each commercial feed,
except customer—formula feed and contract feed, before
distributing it in the state.

(b) A person shall register [each customer—formula
feed manufacturing facility] ONLY THOSE CUSTOMER-FORMULA
FEED MANUFACTURING FACILITIES WHICH PRODUCE A GUARANTEED
ANALYSIS FEED and if a person has two or more portable
customer—formula feed mixers, he shall register [each
mixer] THOSE WHICH PRODUCE A GUARANTEED ANALYSIS FEED.

.(c). The registration application for commercial
feeds shall be submitted on forms furnished by the
Secretary, and shall also be accompanied by a label or
other printed matter describing the product if requested
by the Secretary. The application shall include the
information required by Sections 6—109, 6-110, and 6—111.
The registration application for customer—formula feed
manufacturing facilities and portable customer—formula
feed mixers, BOTH OF WHICH PRODUCE A GUARANTEED ANALYSIS
FEED, shall be submitted on forms furnished by the
Secretary, and shall include the applicant's name, place
of business, location of each facility, and such other
information as the Secretary may prescribe. When the
Secretary has approved the registration, he shall furnish
a copy to the applicant.

(d) The annual registration fee for each commercial
feed distributed in the state is $20. Customer—formula
feeds and contract feeds are exempt if the registration
fee is paid on the commercial feeds which they contain.
In addition, any distributor shall pay an annual
registration fee of $25 for each brand of commercial feed
distributed in individual packages of to pounds or less.
[The annual registration fee for each nonportable
customer—formula feed manufacturing facility in the state
is $100. The annual registration fee for portable
customer—formula feed mixers used in the state is $20 for
each mixer; provided, however, that for any person owning
five or more such mixers, the annual registration fee is
$100; and provided, further, that for any person
registering a nonportable customer—formula feed

manufacturing facility and paying the fee therefor, there
shall be no additional fee for the registration of that
