(1974 Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 13-302(b-1) be and it is
hereby added to Article — Estates and Trusts, of the
Annotated Code of Maryland (1974 Volume and 1974
Supplement) to read as follows:

Article — Estates and Trusts

13-302.

(B-1) A DONOR WHO MAKES A GIFT TO A MINOR IN A

MANNER PRESCRIBED IN SUBSECTION (A) OF THIS SECTION MAY
PROVIDE THAT THE CUSTODIAN SHALL DELIVER, CONVEY, OR PAY
IT OVER TO THE MINOR ON HIS ATTAINING THE AGE OF 21
YEARS.

SECTION 2. AND BE IT FURTHER ENACTED, That Section
13-304(d) of Article — Estates and Trusts, of the
Annotated Code of Maryland (1974 Volume and 1974
Supplement) be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

Article — Estates and Trusts

13-304.

(d) To the extent that the custodial property is
not expended, AND EXCEPT FOR GIFTS MADE IN ACCORDANCE
WITH THE PROVISIONS OF SECTION 13-302(B-1) OF THIS
SUBTITLE, the custodian shall deliver, convey, or pay it
over to the minor on his attaining the age of 18 years,
or, if the minor dies before attaining the age of 18
years, he shall thereupon deliver or pay it over to the
estate of the minor.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
