other Federally funded programs from the limit of
500 new positions which can be created by the Board
of Public Works as contained in Section 8 of the
1975 State Budget (Chapter 288, Acts of 1974).
BY repealing and re—enacting, with amendments,
Chapter 288, Acts of 1974

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 8 of Chapter 288, Acts of 1974,
([of the Code of Maryland]] be and it is hereby repealed
and re—enacted, with amendments, to read as follows:

SECTION 8. AND BE IT FURTHER ENACTED, That
immediately following the close of each fiscal year the
Secretary of Budget and Fiscal Planning shall determine
the total number of State positions that are authorized
as of the last day of the fiscal year. Authorized
positions shall include all budget positions as shown in
the personnel detail of the annual budget for the ensuing
fiscal year including non—budgeted programs, the Mass
Transit Administration, the University of Maryland
self—supported activities, and the State—use Industries.
The Board of Public Works, in exercising its authority to
create additional positions pursuant to Sec. 16B of
Article 78A, may authorize, during any fiscal year, up to
five hundred (500) positions in excess of the total
number of authorized State positions as determined by the
Secretary of Budget and Fiscal Planning on the last day
of any fiscal year. Provided, however, that if the
imposition of this ceiling causes undue hardship in any
particular department, agency, board, or commission, the
Board of Public Works may authorize additional positions
for such department, agency, board, or commission, upon
the elimination of an equal number of authorized
positions in another department, agency, board or
commission, and said action shall be exempt from the
aforementioned ceiling of five hundred (500) [.]; AND
THAT THE AFOREMENTIONED CEILING OF FIVE HUNDRED (500)
DOES NOT APPLY WITH RESPECT TO ANY POSITIONS CHEATED BY
THE BOARD OF PUBLIC WORKS DURING FISCAL YEAR 1975 WHICH
ARE FULLY FUNDED BY THE FEDERAL GOVERNMENT UNDER THE
FEDERAL EMERGENCY UNEMPLOYMENT COMPENSATION ACT OF 1974,
THE FEDERAL EMERGENCY JOBS AND UNEMPLOYMENT ASSISTANCE
ACT OF 1974, AND ANY OTHER FEDERAL MAN-POWER STATUTES;
AND ANY POSITIONS FOR WHICH THE STATE RECEIVES [[FEDERAL
FUNDS]] FULL FEDERAL FUNDING IN CONNECTION WITH PROGRAMS
