his home, garden, or yard;

(8) Application of any pesticide by any person under
the direct supervision of a registered custom applicator
or a registered pest control operator, or by a person
applying pesticides to his home, garden, or yard;

(9) Application of any pesticide by any arborist
licensed by the Department of Natural Resources;

(10) Application of any pesticide on ornamental
trees or plants on residential properties of one acre or
less.]

SECTION 2. AND BE IT FURTHER ENACTED, That Sections
5-201, 5-203, 5-204, 5-205, 5-206, 5-207 and 5-209 of
Article — Agriculture, of the Annotated Code of Maryland
(1974 Volume and 1974 Supplement) be and they are hereby
repealed and re—enacted, with amendments, to read as
follows:

Article — Agriculture

5-201.

(a)  In this subtitle the following words have the
meanings indicated.

(b)  "Application" means the spreading of pesticides,
by contract or otherwise, for any person owning or
renting property.

(C) "CERTIFIED APPLICATOR" MEANS ANY INDIVIDUAL TO
WHOM THE SECRETARY HAS ISSUED A CERTIFICATE UNDER THIS
SUBTITLE.

[[(c)]] (D) "Custom applicator" means any person who
is engaged in the business of applying by air, ground,
hand, or mechanical equipment, pesticides to water, land,
plants, farm structures, or animals.

(E)    "DEFOLIANT" MEANS ANY SUBSTANCE OR MIXTURE OF
SUBSTANCES INTENDED TO CAUSE LEAVES OR FOLIAGE TO DROP
FROM A PLANT. WITH OR WITHOUT CAUSING ABSCISSION.

(F)    "DESICCANT" MEANS ANY SUBSTANCE OR MIXTURE OF
SUBSTANCES INTENDED TO ACCELERATE ARTIFICIALLY THE DRYING
OF PLANT TISSUES.

[[(d)]] (G) "Device" means any instrument or
mechanical device intended to trap, destroy, control,
repel, or mitigate pests.
