LAWS OF MARYLAND

[Ch. 314

(H) "GENERAL USE PESTICIDE" MEANS A PESTICIDE SO
CLASSIFIED BY THE FEDERAL GOVERNMENT.

[[(e)]] (I) "Pest" means (1) any insect, snail,
slug, rodent, nematode, fungus, weed, or (2) any other
form of terrestrial or aquatic plant or animal life or
virus, bacteria, or other microorganism (except viruses,
bacteria, or other microorganisms on or in living man or
any other living animal) which normally is considered to
be a pest or which the Secretary declares to be a pest.

[[(f)]] (J) "Pesticide" means (1) any substance or
mixture of substances intended for preventing,
destroying, repelling, or mitigating any pest, (2) any
substance or mixture of substances intended for use as a
plant regulator, defoliant, or desiccant, and (3) any
substance or mixture of substances intended to be used as
a spray adjuvant such as a wetting agent or adhesive.

[[(g)]] (K) "Pest control consultant" means any
person who engages in the business of offering or
supplying technical advice or supervision, or
recommending the use of specific pesticides for the
purpose of controlling pests in or on water, land,
plants, farm structures, or animals.

[(h)]] (L) "Pest control [operator] APPLICATOR"
means a person engaged in the business of structural pest
control, commercial extermination [[or]] , fumigation, or
[[in]] PROVIDING any other service involving the use of
pesticides or devices for controlling, eradicating,
mitigating, or preventing pests in or around any house or
building.

[[(I)]] (M) "PRIVATE APPLICATOR"    MEANS A PERSON WHO

USES ANY RESTRICTED USE PESTICIDE AND     WHO PRODUCES ANY
AGRICULTURAL COMMODITY ON PROPERTY OWNED OR RENTED BY HTM

OR HIS EMPLOYER OR, IF APPLIED WITHOUT   COMPENSATION OTHER

THAN TRADING OF PERSONAL SERVICES     BETWEEN PRODUCERS

[[OR]] OF AGRICULTURAL COMMODITIES, ON    THE PROPERTY OF
ANOTHER PERSON.

[[(J)]] (N) "PUBLIC AGENCY APPLICATOR" MEANS ANY
PERSON EMPLOYED BY ANY UNIT OF FEDERAL, STATE, COUNTY OR
LOCAL GOVERNMENT OR ANY TRAINING INSTITUTION ENGAGED IN
PEST CONTROL, EXTERMINATION OR FUMIGATION, OR INVOLVED IN
THE USE OF PESTICIDES OR DEVICES FOR CONTROLLING,
ERADICATING, MITIGATING, OR PREVENTING PESTS.

[[(K) "GENERAL USE PESTICIDE" MEANS A PESTICIDE SO
CLASSIFIED BY THE FEDERAL GOVERNMENT.]]

[[(L)]] (O) "RESTRICTED USE PESTICIDE" MEANS A
PESTICIDE SO CLASSIFIED BY THE FEDERAL GOVERNMENT OR THE
