CHAPTER 291

(Senate Bill 174)

AN ACT concerning

Uninsured Motor Vehicles — Penalty

FOR the purpose of providing for penalties, to be
assessed by the Administrator, against motorists
whose vehicles become uninsured during the
registration year [[for certain lengths of time]];
and providing that the proceeds of these charges
shall be paid to the uninsured section of the
Maryland Automobile Insurance Fund.

BY adding to

Article 66 1/2 — Vehicle Laws

Section 7-102(d)

Annotated Code of Maryland

(1970 Replacement Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 7-102(d) be and it is hereby
added to Article 66 1/2 — Vehicle Laws, of the Annotated
Code of Maryland (1970 Replacement Volume and 1974
Supplement) to read as follows:

Article 66 1/2 - Vehicle Laws

7-102.

(D)          AT ANY TIME DURING THE REGISTRATION YEAR, IF A

MOTOR VEHICLE BECOMES AN UNINSURED MOTOR VEHICLE [[FOR
NOT LONGER THAN 25 DAYS]], THE ADMINISTRATOR [[SHALL]]
WAY ASSESS A PENALTY OF UP TO [[$10]] $40 PER UNINSURED
MOTOR VEHICLE. [[IF THE MOTOR VEHICLE IS UNINSURED FOR A
PERIOD OF TIME IN EXCESS OF 25 DAYS, THE ADMINISTRATOR [[
[[ ]]SHALL[[ ]] ]] [[MAY]] ASSESS A PENALTY OF $40 PER
UNINSURED MOTOR VEHICLE.]] THESE CHARGES ARE IN ADDITION
TO ANY OTHER PENALTIES PROVIDED AGAINST UNINSURED
MOTORISTS UNDER THIS ARTICLE. THE PROCEEDS OF ALL SUCH
CHARGES SHALL BE PAID TO THE UNINSURED SECTION OF THE
MARYLAND AUTOMOBILE INSURANCE FUND.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
