INSTITUTION SHALL BE appointed by the Secretary of Public
Safety and Correctional Services, with the approval of
the Governor AND WITH THE ADVICE AND CONSENT OF THE
SENATE [, to serve for a five—year term each]. MEMBERS
APPOINTED BY THE SECRETARY SHALL SERVE FOR TERMS OF POOR
YEARS. MEMBERS OF THE BOARD OF PATUXENT INSTITUTION AND
THE ADVISORY BOARD FOR DEFECTIVE DELINQUENTS HOLDING
OFFICE ON JULY 1, 1975 SHALL CONTINUE TO SERVE THE
REMAINDER OF THEIR TERMS, The [advisory] board shall
organize by electing a chairman, and shall meet on the
call of the chairman or of the Secretary of Public Safety
and Correctional Services at least [once in every three
months.] EIGHT TIMES IN EACH YEAR. One of the members of
the [said] board shall serve as secretary upon
designation by the chairman and shall keep full and
accurate minutes of [such] meetings and preserve the
same. [The members of the advisory board shall receive
a per diem payment for every day spent in the duties of
the board. The advisory board shall confer with the
staff of the Institution, and with the board from time to
time, and shall give to the Institution a general
consultative and advisory service on problems and matters
relating to its work.]
(B) THE SECRETARY OF PUBLIC SAFETY AND CORRECTIONAL
SERVICES, WITH THE APPROVAL OF THE GOVERNOR, MAY REMOVE
ANY MEMBER OF THE BOARD FOR GOOD CAUSE SHOWN. A VACANCY
ON THE BOARD SHALL BE FILLED BY APPOINTMENT BY THE
SECRETARY, WITH THE APPROVAL OF THE GOVERNOR, FOR THE
UNEXPIRED TERM. APPOINTMENTS SHALL BE CONSISTENT WITH THE
REQUIREMENTS FOR MEMBERSHIP SET FORTH IN SUBSECTION (A).
(C) THE BOARD SHALL CONFER WITH THE STAFF OF THE
INSTITUTION AND WITH THE SECRETARY OF PUBLIC SAFETY AND
CORRECTIONAL SERVICES FROM TIME TO TIME, AND SHALL GIVE A
GENERAL CONSULTATIVE AND ADVISORY SERVICE ON PROBLEMS AND
MATTERS RELATING TO ITS WORK. A MAJORITY OF THE BOARD
SHALL BE A QUORUM FOR THE TRANSACTION OF ALL BUSINESS.
THE BOARD MAY AUTHORIZE ANY MEMBER TO EXECUTE ANY PAPERS
ON ITS BEHALF. THE BOARD MAY SUMMON WITNESSES AND
ADMINISTER OATHS. FAILURE TO APPEAR BEFORE THE BOARD IN
ANSWER TO A SUMMONS, OR REFUSING TO TESTIFY IS PUNISHABLE
BY A FINE OF NOT LESS THAN $25 NOR MORE THAN $50.
(D) BOARD MEMBERS SHALL RECIEVE A PER DIEM PAYMENT
FOR EVERY DAY SPENT IN THE DUTIES OF THE BOARD.
[(b)] (E) [No] A surgical operation [shall] MAY NOT
be performed as treatment of any defective delinquent
except as authorized by the approval of the advisory
board and also by the written consent of the defective
delinquent, his nearest relative, or the order of the
court.
