SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 4-1027 of Article - Natural
Resources, of the Annotated Code of Maryland (1974 Volume
and 1974 Supplement) be and it is hereby repealed:

4-1027.
[Any person wishing to engage in the business of
shipping or selling hard—shell clams taken from the
waters of the State first shall obtain a license from the
clerk of the Circuit court of the county where the
applicant resides. An applicant shall pay a $25 license
fee and 50 cents to cover the cost of issuance to the
clerk of the Circuit court. This license shall be valid
only for the calendar year in which it is issued. The
clerk of the Circuit court shall send monthly to the
Department a record of every license issued under the
provisions of this subsection. This section is not
intended to prohibit any licensee from selling his own
catch without a shipper's or dealer's license.]
SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 4—1027 be and it is hereby added to Article —
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1974 Supplement) to read as follows:

4-1027.
(A) A PERSON SHALL OBTAIN A CLAM DEALER'S LICENSE
BEFORE ENGAGING IN THE BUSINESS OF SHIPPING OR SELLING
HARD-SHELL CLAMS TAKEN FROM THE WATERS OF THE STATE.
(B) THIS SECTION DOES NOT APPLY TO ANY PERSON
SELLING HIS OWN CATCH.
(C) A CLAM DEALER'S LICENSE MAY BE OBTAINED FROM
THE DEPARTMENT OR THE CLERK OF THE CIRCUIT COURT OF THE
