violated any provisions of this subtitle or any rules and
regulations adopted under it. However, no permit or
license may be revoked or suspended until the holder is
given a hearing by the Secretary after reasonable notice.
THIS SECTION DOES NOT LIMIT THE FIGHT OF THE SECRETARY TO
PROCEED AS AUTHORIZED BY OTHER SECTIONS OF THIS TITLE.
11-407.
(A) Every [permit holder] COOPERATIVE OR OTHER
PURCHASER shall notify the producer of the results of any
test and the basis of payment. [He] THE COOPERATIVE OR
OTHER PURCHASER shall maintain records of the tests and
payment in a manner specified by the Secretary.
(B) EVERY HAULER, UPON RECEIPT OF MILK OF
OTHER FLUID DAIRY PRODUCTS, SHALL PROVIDE IMMEDIATELY THE
PRODUCER WITH A WRITTEN STATEMENT INDICATING THE CORRECT
QUANTITY RECEIVED. HE SHALL PROVIDE ALSO THE COOPERATIVE
OR OTHER PURCHASER WITH A WRITTEN QUANTITY STATEMENT UPON
DELIVERING THE MILK OR OTHER FLUID DAIRY PRODUCTS. THE
STATEMENT PROVIDED TO THE PRODUCER AND THE COOPERATIVE OR
OTHER PURCHASER SHALL CONTAIN OTHER INFORMATION AS
SPECIFIED BY THE SECRETARY.

[A permit holder or licensee may not take, collect
or use for testing purposes any sample which tests] NO
PERSON MAY OBTAIN, COLLECT OR USE ANY SAMPLE, FOR TESTING
PURPOSES, THE TEST RESULT OF WHICH IS lower or higher
than the test of the milk or other fluid dairy product
from which it is [taken] OBTAINED. [He may not
underread, overread or erroneously manipulate the test or
falsify any part of the record of any test used as a
basis for payment to the producer in any milk or other
fluid dairy product purchased.]

[No person may use as a basis of payment to any
producer of milk or other fluid dairy product any weight,
measure, or test which is lower or higher than the
weight, measure, or test of the product from which it is
taken, as determined by the procedures approved by the
Secretary.] NO PERSON MAY INDICATE, RECORD OR REPORT A
FALSE OR INCORRECT QUANTITY OF MILK OR OTHER FLUID DAIRY
PRODUCT, FOR ANY PURPOSE.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
