Chapter 9 of the Acts of the June 9,
1961 Special Session of the General Assembly

PREAMBLE

WHEREAS, It is hereby determined and declared to be
necessary and conducive to the protection of the public
health, safety, and welfare of the citizens of Allegany
County, Maryland, that a public water system be
constructed [in Allegany County] to serve the citizens of
the municipal corporations, sanitary districts, special
taxing areas, and towns [therein] IN ALLEGANY COUNTY, and
the plants, industries and establishments therein and
that said water supply be made available as quickly as is
consistent with sound engineering practices; [now,
therefore] AND

WHEREAS, THE ALLEGANY COUNTY WATER COMMISSION HAS
CREATED A BODY CORPORATE PURSUANT TO THE PROVISIONS OF
CHAPTER 507 OF THE LAWS OF MARYLAND OF 1971 AND GIVEN THE
POWER AND AUTHORITY TO ACQUIRE, DEVELOP AND OPERATE A
PERMANENT WATER SUPPLY SYSTEM FOR ALLEGANY COUNTY AND TO
ACQUIRE PROPERTY AND PROPERTY RIGHTS IN THE STATE OF
MARYLAND IN ORDER TO CARRY OUT ITS PURPOSES, WITHOUT
LIMITATION TO THE SAVAGE RIVER DAM IN GARRETT COUNTY AS A
SOURCE OF WATER SUPPLY; AND

WHEREAS, NONE OF THE AUTHORITY TO ISSUE BONDS UNDER
CHAPTER 9 OF THE ACTS OF THE JUNE 9, 1961 SPECIAL SESSION
OF THE GENERAL ASSEMBLY HAS BEEN EXERCISED AND IT IS
NECESSARY TO INCREASE THE AMOUNT OF BONDS AUTHORIZED TO
BE ISSUED UNDER CHAPTER 9 OF THE LAWS OF MARYLAND ENACTED
AT THE SPECIAL SESSION OF JUNE 9, 1961 IN ORDER TO
ACCOMPLISH THE PUBLIC PURPOSES OF THIS ACT AND OF CHAPTER
507 OF THE LAWS OF MARYLAND OF 1971; NOW, THEREFORE

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Chapter 9 of the Acts of the June 9, 1961
Special Session of the General Assembly are hereby
repealed and re—enacted, with amendments, to read as
follows:

Chapter 9

1. The County Commissioners of Allegany County, a
body corporate, for the purpose of financing the design,
engineering and legal services, right—of—way
acquisitions, the construction and establishment of a
water transmission system OR SYSTEMS, including water
mains, TRANSMISSION CONDUITS, IMPOUNDMENTS, reservoirs or
dams, intakes, laterals, pumping stations, standpipes,
AND OTHER WATER STORAGE FACILITIES filtration and
purification plants, PRESSURE REDUCING AND FLOW CONTROL
