REVISOR'S NOTE: This title presently appears as
Title 15 of Art. 21 of the Code. The former
effective date of §15—101 is proposed for
deletion and the effective date of this Act is
substituted. In §15—102 paragraphs 17 and 18
are new language derived from §8—213 and set
forth here for organizational purposes. In
§15—102, paragraph (20) obsolete language is
proposed for deletion. Section 15—103
presently appears as §15—102(b) and is set
forth as a separate section for organization
purposes. The only other changes are in
style.

SECTION 3. AND BE IT FURTHER ENACTED, That Section
49 of Article 9 of the Annotated Code of Maryland (1968
Replacement Volume, 1973 Supplement) title "Attachments,"
subtitle "Lien of State" be and is hereby repealed and
re—enacted, with amendments, to read as follows:

§49. LIEN BY THE STATE ON PERSONAL PROPERTY.

IF THE STATE COMMENCES A SUIT OR FILES A LIEN
AGAINST THE PERSONAL PROPERTY OF ANY PERSON INDEBTED TO
THE STATE FOR A DEBT OWED, THE PROPERTY IS SUBJECT TO
LAWFUL EXECUTION OF THE LIEN, JUDGMENT, OR DECREE
REGARDLESS OF WHO IS IN ACTUAL POSSESSION OF THE
PROPERTY.

SECTION 4. AND BE IT FURTHER ENACTED, That

subsections (b),(c) and (e) of §2-104 of Article 21 of
the Annotated Code of Maryland (1973 Replacement Volume,
1973 Supplement) "Real Property," title "Statute of
Frauds," be and" they are hereby repealed and re—enacted
as §1 of new Article 39C of the Annotated Code of

Maryland (1971 Replacement Volume, 1973 Cumulative

Supplement), to follow immediately after Article 39B and
to be designated "Statute of Frauds," to read as follows:

1. EXECUTORY CONTRACTS.

NO ACTION MAY BE BROUGHT:

(1) TO CHARGE A DEFENDANT UPON ANY SPECIAL
PROMISE TO ANSWER FOR THE DEBT, DEFAULT OR MISCARRIAGE OF
ANOTHER PERSON; OR

(2) TO CHARGE ANY PERSON UPON ANY AGREEMENT
MADE UPON CONSIDERATION OF MARRIAGE; OR

(3) UPON ANY AGREEMENT THAT IS NOT TO BE

PERFORMED WITHIN THE SPACE OF ONE YEAR FROM THE MAKING

THEREOF;
