HOWARD COUNTY

CERTIFICATE
WORKS.

SHALL BE BINDING ON THE DEPARTMENT OF PUBLIC

H. FAILURE OF THE COMMISSION TO ACT WITHIN

FORTY-FIVE (45) DAYS FROM THE DATE AN APPLICATION IS
FILED SHALL CONSTITUTE APPROVAL UNLESS AN EXTENSION OF
THE FORTY-FIVE (45) DAY PERIOD IS AGREED UPON MUTUALLY BY
THE APPLICANT AND THE COMMISSION OR THE APPLICATION HAS
BEEN WITHDRAWN.

5. THE COMMISSION SHALL SET FORTH, IN

WRITING, ITS REASON FOR REJECTION OF AN APPLICATION
SUBMITTED TO IT FOR REVIEW.

G. - EXCEPTION

NOTHING IN THIS ACT SHALL BE CONSTRUED TO
PREVENT ROUTINE MAINTENANCE OR REPAIR OF ANY STRUCTURE
WITHIN AN HISTORIC DISTRICT.

H. - VIOLATION

WHERE THERE IS ANY VIOLATION OF THIS ACT OR
ANY ACTION TAKEN THEREUNDER, THE ZONING ENFORCEMENT
OFFICER OR HIS DESIGNATED REPRESENTATIVE SHALL INSTITUTE
APPROPRIATE ACTION TO PREVENT, ENJOIN, ABATE OR REMOVE
SUCH VIOLATION.

I. - APPEAL

ANY PERSON OR PERSONS JOINTLY OR SEVERALLY, OR
FIRM OR CORPORATION, AGGRIEVED BY A DECISION OF THE
HISTORIC DISTRICT COMMISSION SHALL HAVE THE RIGHT OF
APPEAL CONCERNING SUCH DECISION OF THE HISTORIC DISTRICT
COMMISSION TO THE CIRCUIT COURT FOR HOWARD COUNTY.

J. - SEVERABILITY

IF ANY WORD, CLAUSE, PARAGRAPH OR SECTION OF
THIS ACT SHALL BE RULED INVALID OR UNCONSTITUTIONAL BY A
COURT OF COMPETENT JURISDICTION, IT SHALL NOT EFFECT THE
VALIDITY OF THIS ACT AS A WHOLE OR ANY PART THEREOF OTHER
THAN THAT PORTION SO JUDGED TO THE INVALID OR
UNCONSTITUTIONAL.

SECTION 2. AND BE IT FURTHER ENACTED BY THE COUNTY
COUNCIL OF HOWARD COUNTY, MARYLAND, that this Act shall
take effect sixty (60) days after its enactment.

This Bill, having been approved by the Executive and
returned to the Council, stands enacted on May 15, 1973.
