COUNTY LOCAL LAWS

was created and has been enlarged by additions thereto
which have been petitioned by various property owners;
and

WHEREAS, in 1965 the New Town Zoning District was
incorporated into the Metropolitan District and as a
result, a number of parcels of land which were not
included in the New Town District became situate within
the perimeter of the enlarged Metropolitan District at
that time and are now not a part of the Metropolitan
District; and

WHEREAS, the existing procedures to incorporate
parcels of land into the Metropolitan District are set
forth in Section 18.201 of the Howard County Code and
require action by the County Council and do not provide a
prompt means to incorporate those existing improved
properties which front on existing water and/or sewer
mains and which are in serious need of such service.

THEREFORE, the following procedure is created in
Howard County to facilitate the incorporation into the
Metropolitan District of improved parcels having an
acreage of 5 acres or less and fronting on an existing
water and/or sewer main.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
HOWARD COUNTY, that a new Section 18.201A inclusive is
added to Title 18, Subtitle 1, be and is hereby added to
the Howard County Code titled "Public Utilities,"
immediately after Section 18.201, and to read as follows:

18.201A AUTHORITY TO PUBLIC WORKS BOARD TO INCORPORATE
INTERNAL PARCELS OF LAND INTO THE METROPOLITAN DISTRICT.

(A)    THE PUBLIC WORKS BOARD IS HEREBY DELEGATED
THE AUTHORITY TO INCORPORATE PARCELS OF LAND INTO THE
METROPOLITAN DISTRICT WHICH MEET THE FOLLOWING CONDITIONS
AND CRITERIA:

(1)    IMPROVED PARCELS OF LAND CONTAINING 5
ACRES OR LESS, LOCATED WITHIN THE EXISTING PERIMETER OF
THE METROPOLITAN DISTRICT.

(2)    THE IMPROVED PARCEL SHALL FRONT ON A
WATER AND/OR SEWER MAIN WHICH IS CAPABLE OF PROVIDING
SERVICE TO THE PARCEL AND A BONAFIDE NEED SHALL EXIST FOR
SUCH SAID SERVICE AS SHALL BE DETERMINED IN WRITING BY
THE COUNTY HEALTH DEPARTMENT.

(B)    THE PARCEL OWNER, MEETING THE ABOVE CONDITIONS
AND REQUIREMENTS, MAY, BY WRITTEN REQUEST TO THE DIRECTOR
OF PUBLIC WORKS, REQUEST THAT THE PUBLIC WORKS BOARD
INCORPORATE THE SAID PARCEL INTO THE METROPOLITAN
