of one hundred per cent (100%) of the participant's basic
rate of earnings in effect as of his date of disability.
However, in no instance shall the amount of pension be
reduced below the amount of accrued pension credited to
the participant on the date disability pension payments
commence. SHOULD A PARTICIPANT BE ASSIGNED TO A HIGHER
CLASSIFICATION AND BE DISABLED WHILE ACTING IN SUCH
CLASSIFICATION, THE PARTICIPANT SHALL RECEIVE BENEFITS
BASED ON THE SALARY HE WOULD HAVE RECEIVED HAD HE BEEN
PROMOTED TO THE HIGHER CLASSIFICATION UNDER PROVISIONS OF
SECTION 1-214(B) OF THE ANNE ARUNDEL COUNTY CODE.
SECTION 2. AND BE IT FURTHER ENACTED, That this
ordinance shall take effect forty-five (45) days from the
date it becomes law, provided that the provisions thereof
shall be applied retroactively to July 1, 1973.

AN ORDINANCE to repeal and re—enact, with amendments,
Section 14-308 (a) (4) of the Anne Arundel County
Code (1967 Edition and Supplements), Title 14,
"Police", Subtitle 3, "Police and Fire Service
Retirement", to change the method of determining
death benefits under the police and fire service
retirement*
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That Section 14-308 (a)
(4) of the Anne Arundel County Code (1967 Edition and
Supplements), Title 14, "Police", Subtitle 3, "Police and
Fire Service Retirement", be, and it is hereby repealed
and re—enacted, with amendments, to read as follows:
Section 14-308 (a)
(4) The monthly amount of death benefits payable in
respect to a participant whose death occurs as a direct
result of the active performance of his duties shall be
equal to sixty—six and two—thirds per cent (66 2/3%) of
the participant's final earnings. SHOULD A PARTICIPANT
BE ASSIGNED TO A HIGHER CLASSIFICATION AND HIS DEATH
OCCURS WHILE ACTING IN SUCH CLASSIFICATION, THE AMOUNT OF
DEATH BENEFITS PAYABLE WILL BE BASED UPON THE SALARY HE
WOULD HAVE RECEIVED HAD HE BEEN PROMOTED TO THE HIGHER
CLASSIFICATION UNDER THE PROVISIONS OF SECTION 1-214(B)
OF THE ANNE ARUNDEL COUNTY CODE.
