shall impound same also if they are unable to locate the
true owners of said bicycle or bicycles.

If any of the foregoing impounded bicycles are not
redeemed within thirty (30) days front the impounding of
same where the owner is not known, or within thirty (30)
days of the impounding of same where the owner is known
and has been notified in writing of the impoundment of
said bicycle, then the Police Department, in compliance
with rules and regulations promulgated by the Chief of
Police, who is the chief administrative officer in charge
of this program shall sell said bicycles at public sale
to the highest bidder, after having been duly advertised
by publishing notice of the time and place of such sale
at least once ten (10) days prior to the sale, in some
newspaper published in the City.

Section 9—11. Violation and Penalty.

Anyone violating the provisions of this Ordinance
shall be subject to prosecution before the District Court
for Hagerstown, Maryland, and upon conviction, shall be
fined not more than $10.00.

EFFECTIVE: February 4, 1974.

AN ORDINANCE

An ordinance to repeal and re—enact with amendments
paragraph A of section 4—39 of the code of the city of
Hagerstown, Maryland, 1967, title "Administration",
sub—title "Partial Exemption for City Taxes for certain
persons".

SECTION I: BE IT ENACTED AND ORDAINED BY THE MAYOR
AND COUNCIL OF THE CITY OF HAGERSTOWN that Paragraph A
of Section 4—39 of the Code of the City of Hagerstown,
Maryland 1967, title "Administration", sub-title "Partial
Exemption for City Taxes for Certain Persons", be and the
same is hereby repealed and re—enacted with amendments to
read as follows:

Section 4—39. Partial exemption for city taxes for
certain persons.

A. Every person over the age of 65 years who has
been a bona fide resident of the City of Hagerstown for
the preceding 1 year, and whose total gross income is
$3,000.00 or less per year from all sources, and who has
