MUNICIPAL CHARTERS
THE ADVICE AND CONSENT OF THE BOARD OF ALDERMEN FOR TERMS
OF FOUR YEARS. THE MEMBERS OF THE BOARD OF ZONING
APPEALS IN OFFICE AT THE TIME OF THIS CHARTER BECOMES
EFFECTIVE SHALL SERVE UNTIL THE EXPIRATION OF THEIR
PRESENT TERMS OF OFFICE. ANY MEMBER OF THE ZONING BOARD
OF APPEALS MAY BE REMOVED BY THE BOARD OF ALDERMEN FOR
CAUSE AFTER BEING GIVEN A WRITTEN COPY OF THE CHARGES
AGAINST HIM AND A PUBLIC HEARING THEREON. ANY VACANCY
SHALL BE FILLED BY THE MAYOR WITH THE ADVICE AND CONSENT
OF THE BOARD OF ALDERMEN FOR THE REMAINDER OF THE
UNEXPIRED TERM. THE COMPENSATION OF MEMBERS OF THE
ZONING BOARD OF APPEALS SHALL BE DETERMINED BY THE BOARD
OF ALDERMEN. [THE MAYOR WITH THE ADVICE AND CONSENT OF
THE BOARD OF ALDERMEN MAY APPOINT SUCH ALTERNATE MEMBERS
AS MAY BE REQUIRED FROM TIME TO TIME.]
SECTION II: BE IT FURTHER RESOLVED, that the date
of passage of this Resolution shall be July 26, 1973, and
the amendment to the Charter of the City of Frederick,
hereby enacted, shall become effective on September 15,
1973, unless a proper petition for a referendum herein
shall be filed as provided by Section 13 of Article 23A
of the Annotated Code of Maryland, and provided a
complete and exact copy of this Resolution shall be
continuously posted at City Hall, Frederick, Maryland,
until September 15, 1973, and provided further that a
fair summary of the proposed amendment shall be published
in the News—Post, a newspaper of general circulation in
the City of Frederick, once in each of the weeks of July
29, 1973, August 5, 1973, August 12, 1973 and August 19,
1973; and all sections of the Charter or ordinances or
parts of sections of the Charter or ordinances
inconsistent with the provisions of this Resolution be
and the same are hereby repealed to the extent of such
inconsistency.
SECTION III: BE IT FURTHER RESOLVED AND ORDAINED
that the Mayor of the City of Frederick shall send
separately by registered mail to the Secretary of the
State of Maryland and the Department of Legislative
Reference the complete text hereof; the date of
referendum election, if any; the number of votes cast for
and against the question containing the Charter
amendment, whether in the legislative body or in a
referendum and effective date of the charter amendment.
