RESOLUTION 4-73
A RESOLUTION to propose an amendment to Article XV
of the Charter, entitled "Planning and Zoning", Sections
176 and 186 by repealing Sections 176 and 186 and placing
in lieu thereof a new Section 176 and 186.
SECTION I: BE IT RESOLVED, ENACTED AND ORDAINED BY
THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF FREDERICK,
that the Charter of the City of Frederick, as the same
was enacted by the General Assembly of Maryland in
Chapter 539 of the laws of 1951, be amended by repealing
Article XV, Sections 176 and 186 in their entirety and
placing in lieu thereof the following:
Article XV. Planning and Zoning.
SEC. 176. PLANNING COMMISSION - COMPOSITIONS;
APPOINTMENT; TERM; REMOVAL; COMPENSATION.
THERE SHALL BE A PLANNING COMMISSION WHICH SHALL
CONSIST OF FIVE MEMBERS, NAMELY, A MEMBER OF THE BOARD OF
ALDERMEN, AND FOUR PERSONS, ALL RESIDENTS OF THE CITY OF
FREDERICK, WHO SHALL BE APPOINTED BY THE MAYOR WITH THE
ADVICE AND CONSENT OF THE BOARD OF ALDERMEN. THE TERM OF
THE EX OFFICIO MEMBER SHALL CORRESPOND TO HIS OFFICIAL
TENURE. THE TERM OF EACH MEMBER SHALL BE FIVE YEARS OR
UNTIL HIS SUCCESSOR TAKES OFFICE, EXCEPT, THAT THE
RESPECTIVE TERMS OF THE FIVE MEMBERS FIRST APPOINTED
SHALL BE ONE, TWO, THREE, FOUR AND FIVE YEARS. THE
PRESENT MEMBERS OF THE PLANNING COMMISSION SHALL CONTINUE
TO SERVE AS MEMBERS UNTIL THIS RESOLUTION BECOMES
EFFECTIVE, AFTER WHICH THE PLANNING COMMISSION SHALL BE
APPOINTED WITHIN THIRTY DAYS IN ACCORDANCE HEREWITH. THE
COMMISSION SHALL APPOINT ONE OF ITS MEMBERS AS CHAIRMAN.
THE COMPENSATION OF MEMBERS OF THE PLANNING COMMISSION
SHALL BE DETERMINED BY THE BOARD OF ALDERMEN. MEMBERS
MAY BE REMOVED BY THE BOARD OF ALDERMEN AFTER A HEARING,
FOR INEFFICIENCY, NEGLECT OF DUTIES OR MALFEASANCE IN
OFFICE. [THE MAYOR WITH THE ADVICE AND CONSENT OF THE
BOARD OF ALDERMEN MAY APPOINT SUCH ALTERNATE MEMBERS AS
MAY BE REQUIRED FROM TIME TO TIME.]
SEC. 186. ZONING BOARD OF APPEALS - COMPOSITION;
APPOINTMENT; TERM; REMOVAL; VACANCIES; COMPENSATION.
THERE SHALL BE A ZONING BOARD OF APPEALS WHICH SHALL
CONSIST OF FIVE MEMBERS TO BE APPOINTED BY THE MAYOR WITH
