3226                                    EXECUTIVE ORDERS

These members shall serve for a term of four
years, but may be removed by the Governor for
(1) conviction of a crime involving moral
turpitude, or entering a plea of nolo
contendere to a charge thereof; (2) loss of
professional registration in the event the
member is an architect or engineer; (3)
failure to attend regularly the meetings of
the Board; (4) undue disqualification from
participation in matters coming before the
board by reason of conflict of interests; or
(5) other misconduct affecting the rendering
of fair and impartial decisions on matters
coming before the Board. As a condition
precedent to their appointment, they shall
affirm that neither they, nor any firm or
corporation with which they are associated,
intends to solicit or negotiate for any
contracts with the State for the rendition of
professional engineering or architectural
services on other than a competitive bid
basis, and that they will not participate in
any manner with respect to any matter coming
before the Board in which they, or any firm or
corporation with which they are associated,
has an interest.

2. (a) No contract for the rendition of
professional engineering or architectural
services on other than a competitive bid basis
shall be entered into or recommended to the
Board of Public Works by the Department of
Transportation or any of its constituent
agencies unless approved by the Transportation
Professional Service Selection Board in
accordance with this section.

(b) The Transportation Professional
Service Selection Board shall, as soon as
practicable, prepare forms designed to elicit
and demonstrate the qualifications of
engineers and architects for projects likely
to come before it; and it shall thereafter
give reasonable public notice of an invitation
to registered engineers and architects to
submit their qualifications to the board on
these forms. The board shall then prepare
lists of engineers and architects deemed by it
to be qualified to render professional
services on projects likely to be submitted to
it. The board may prepare master lists and,
if it deems advisable, subsidiary lists for
specific types of projects. Any registered
