WHEREAS, The Secretary of Transportation further proposed
in his Report the creation of Qualification
Committees within each of the modal Administrations
of the Department of Transportation for the purpose
of making recommendations to the Professional
Service Selection Board on projects involving their
respective Administrations;
WHEREAS, It appears that these particular recommendations
can be implemented by Executive Order pursuant to
Article II, Section 24 of the Constitution of
Maryland and Article 41, Sections 15C and 15CB of
the Annotated Code of Maryland without embarking the
State on any new programs and without being
inconsistent with existing law;
NOW, THEREFORE, I, MARVIN MANDEL, GOVERNOR OF MARYLAND,
PURSUANT TO THE AUTHORITY VESTED IN ME BY ARTICLE
II, SECTION 24 OF THE CONSTITUTION OF MARYLAND AND
BY ARTICLE 41, SECTIONS 15C AND 15CB OF THE
ANNOTATED CODE OF MARYLAND, HEREBY PROMULGATE THE
FOLLOWING ORDER, EFFECTIVE IMMEDIATELY:
1. The Transportation Professional Service
Selection Board is created as part of the Department
of Transportation. It consists of four permanent
members and one floating member and shall be chosen
as follows:
(a) The Secretary of Transportation,
or his designee, is an ex officio member, and
has the power to vote;
(b) The State Aviation Administrator,
the Maryland Port Administrator, the Mass
Transit Administrator, the Motor Vehicle
Administrator, and the State Highway
Administrator, or their respective designees,
shall each be a floating member, ex officio,
but with the power to vote. Each such
Administrator or his designee shall sit with
the Board and vote and otherwise participate
only with respect to projects primarily
involving his Administration.
(c) One member shall be chosen by the
Governor, from within the Department of
Transportation upon the recommendation of the
Secretary of Transportation, and shall serve
at the pleasure of the Governor.
(d) Two members shall be chosen by the
Governor from the general public, at least one
of whom shall not be an engineer or architect.
