3220 EXECUTIVE ORDERS
WHEREAS, Unlawful profiteering in the face of the
existing emergency situation threatens to disrupt
State plans for a fair and equitable system of
allocating these scarce energy resources and is,
therefore, directly detrimental to the State's
efforts to discharge its responsibilities to the
citizens of Maryland; and
WHEREAS, Local monitoring and enforcement of price
controls on the sale of scarce energy resources,
including punishment for violations of such
controls, is an important State interest and is
reasonable and necessary to protect the health,
safety, and welfare of the public;
NOW, THEREFORE, I, MARVIN MANDEL, GOVERNOR OF THE STATE
OF MARYLAND, BY VIRTUE OF THE AUTHORITY VESTED IN ME
BY ARTICLE 41, SECTION 15B OF THE ANNOTATED CODE OF
MARYLAND (1971 REPLACEMENT VOLUME AND 1973
CUMULATIVE SUPPLEMENT, AS AMENDED BY CHAPTER 1 OF
THE ACTS OF 1973, SECOND SPECIAL SESSION), AND
BECAUSE I AM ADVISED AND INFORMED THAT THE FOLLOWING
IS REASONABLE AND NECESSARY IN VIEW OF THE SITUATION
OF EMERGENCY, DO HEREBY PROCLAIM AND ISSUE THE
FOLLOWING ORDER, EFFECTIVE 12:01 A.M., JANUARY 10,
1974:
1. The following products and items,
including all grades and classifications
of each of them, are subject to the
provisions of this Order: gasoline;
kerosene; diesel fuel; distillate and
residual fuel oil; and aviation fuel.
2. With respect to any sale or other
disposition of a product or item listed
in Section 1 of this Order, no person
may charge a price which exceeds the
highest price then authorized to be
charged, by that person for that product
or item, by or under the authority of
the Economic Stabilization Act of 1970,
as amended from time to time, or by any
other applicable federal or State law,
order, rule, or regulation.
3. Each person subject to this Order shall,
upon request, make available for
inspection by any State or local law
enforcement officer or any
representative of the State Energy
Policy Office, all records which would
evidence that the prices charged by that
person are and have been in compliance
