AN ACT concerning

Montgomery County — Public Service Disclosures

FOR the purpose of providing that every public service
company operating in Montgomery County shall furnish
information regarding the location of its
underground utility lines and underground structures
to certain persons, firms, and corporations; shall
mark on the ground the location of such lines and
structures,, shall furnish a certification, and shall
show, on any site drawing or plan submitted by the
requester, the location of its underground lines or
structures; and generally relating to public service
companies in Montgomery County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 28A be and it is hereby added
to Article 78 - Public Service Commission law, of the
Annotated Code of Maryland (1969 Replacement Volume and
1973 Supplement) to read as follows:

Article 78 — Public Service Commission Law
28A.

(A) EACH PUBLIC SERVICE COMPANY OPERATING IN
MONTGOMERY COUNTY, UPON REQUEST BY CERTAIN PARTIES, SHALL
FURNISH INFORMATION TO THE REQUESTER SHOWING THE LOCATION
OF ITS EXISTING UNDERGROUND UTILITY LINES AND UNDERGROUND
STRUCTURES IN THE MANNER HEREINAFTER PROVIDED. A PARTY
ENTITLED TO MAKE SUCH REQUEST IS ANY PERSON, PARTNERSHIP,
CORPORATION OR PUBLIC AGENCY WHICH INTENDS TO GRADE,
STRIP, EXCAVATE, CLEAR, TRANSPORT OR FILL LAND IN
MONTGOMERY COUNTY, OR MOVE EARTH IN MONTGOMERY COUNTY,
FOR THE PURPOSES OF CONSTRUCTION, DEVELOPMENT, LAND
CLEARING OR EARTH MOVEMENT. ALL SUCH REQUESTS SHOULD BE
MADE NO MORE THAN 30 DAYS OR LESS THAN SEVEN DAYS PRIOR
TO THE SCHEDULED COMMENCEMENT OF WORK. ALL SUCH REQUESTS
SHALL BE ACCOMPANIED BY TWO COPIES OF A SITE DRAWING OR
PLAN SHOWING WHERE THE WORK WILL TAKE PLACE, IF SUCH SITE
DRAWINGS OR PLANS ARE REQUIRED BY MONTGOMERY COUNTY OR
