Article 25 - County Commissioners

Section 10D—1

Annotated Code of Maryland

(1973 Replacement Volume and 1973 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 10D-1 be and it is hereby
added to Article 25 - County Commissioners, of the
Annotated Code of Maryland (1973 Replacement Volume and
1973 Supplement) to read as follows:

Article 25 — County Commissioners
10D-1.

(A)    THE COUNTY COMMISSIONERS OF ST. MARY'S COUNTY
MAY RAISE THE BUILDING PERMIT FEES UP TO TWO PERCENT OF
THE COST OF ANY NEW CONSTRUCTION OF ANY LIVING UNITS
BUILT IN ST. MARY'S COUNTY, OR PREBUILT AND BROUGHT INTO
ST. MARY'S COUNTY[[.]]: THE BUILDING PERMIT FEES SHALL BE
SET BY THE COUNTY COMMISSIONERS IN DECEMBER OF EACH YEAR.

(B)    THE COUNTY COMMISSIONERS OF ST. MARY'S COUNTY
MAY REQUIRE EVERY PERSON, FIRM, PARTNERSHIP, CORPORATION,
OR OTHER LEGAL ENTITY WHICH SUBMITS ITS PROPERTY PLANS
FOR APPROVAL TO THE PLANNING AND ZONING COMMISSION (OR
THE APPROPRIATE APPROVING AUTHORITY) TO PAY UP TO $200
FOR: (I) EACH LIVING UNIT, OR LIVING UNIT SPACE, IN ITS
PLANNED COMMUNITY DEVELOPMENT, APARTMENT HOUSE, TOWN
HOUSE, CONDOMINIUM, CAMPER PARK, TRAILER PARK, OR
RECREATIONAL PARK; AND (II) EACH LOT IN A SUBDIVISION.
THE SUMS ABE TO BE PAID TO THE COUNTY COMMISSIONERS
WITHIN 30 DAYS AFTER THE APPROVAL OF THE PROPERTY PLANS
BY THE PLANNING AND ZONING COMMISSION (OR THE APPROPRIATE
APPROVING AUTHORITY) AND PRIOR TO THE RECORDING, IF
NECESSARY, OF THE PLATS OR PLANS.

(C)    THE INCOME DERIVED FROM SUBSECTIONS (A) AND
(B) SHALL BE USED TO DEFRAY THE ADDITIONAL COST TO ST.
MARY'S COUNTY FOR ADDITIONAL EDUCATIONAL, WATER,
SEWERAGE, ROAD, SANITATION, OR SIMILAR FACILITIES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
[[shall take effect July 1, 1974.]] is hereby declared to
be an emergency measure and necessary for the immediate

preservation of the public health and safety__and having

been passed by a yea and nay vote supported by
three-fifths of all the members elected to each of the
two Houses of the General Assembly, the same shall take
effect from the date of its passage.
