any county in any fiscal year over or above funds which
would be allocated if sidewalks were not constructed.

[[(B) THE STATE HIGHWAY ADMINISTRATION, UPON
APPLICATION SHALL CONSTRUCT A SIDEWALK ALONG AN
URBAN-TYPE HIGHWAY WITHOUT WAITING FOR HIGHWAY
CONSTRUCTION OR RECONSTRUCTION, IF THE CONSTRUCTION OR
RECONSTRUCTION IS NOT SCHEDULED TO OCCUR DURING THE
ENSUING TWO YEARS. THIS ACTION SHALL BE DONE WHEN, BY
APPLICATION OF STANDARD ENGINEERING PRACTICE, IT IS SHOWN
THAT THE AMOUNT AND NATURE OF PEDESTRIAN USAGE AND
VEHICLE TRAFFIC ARE ALREADY SIGNIFICANT.

(C) NOTHING IN THIS SECTION MAY BE CONSTRUED TO
PREVENT THE STATE HIGHWAY ADMINISTRATION FROM ENTERING
INTO AN AGREEMENT TO CONSTRUCT SIDEWALKS ALONG STATE
ROADS AS REQUESTED BY THE LOCAL GOVERNING BODY IF THE
CONSTRUCTION IS NOT JUSTIFIED BY A TRAFFIC ENGINEERING
STUDY, PROVIDED THE LOCAL GOVERNING BODY AGREES TO
REIMBURSE THE STATE HIGHWAY ADMINISTRATION FOR THE COST
OF CONSTRUCTION.]]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
