(c) If a reasonable price cannot be agreed upon,
or if the owner is legally incapacitated or is absent,
unknown or unable to convey valid title, the Authority
may acquire by condemnation or by the exercise of the
power of eminent domain any lands, property, rights,
rights—of-way, franchises, easements and other property,
including public lands, parks, playgrounds, reservations,
or parts thereof or rights therein, of any person,
copartnership, association, railroad, public service,
public utility or other corporation, municipality or
political subdivision deemed by the Authority to be
necessary for the construction or the efficient operation
of any project. The proceedings shall be conducted, and
the compensation to be paid shall be ascertained and
paid, in the manner provided by Title 12 of THE REAL
PROPERTY Article [21] of [this] THE Code. The exercise
of the right of condemnation is limited to property
entirely within the territorial jurisdiction of the
Authority.

SECTION 8. AND BE IT FURTHER ENACTED, That Section
46, of Article 64B — Metropolitan Transit District, of
the Annotated Code of Maryland (1972 Replacement Volume
and 1973 Supplement) be and it is hereby repealed and
re—enacted, with amendments, to read as follows:

Article 64B — Metropolitan Transit District
46.

The Authority may acquire by condemnation any
property having a legal situs in the District, and any
right, title, interest, easement or privilege therein,
for or in connection with any matter or thing which is
contemplated to come under or within the jurisdiction,
power or authority of the Authority. In addition, the
Authority may acquire by condemnation all or any part of
the assets and property, real and personal, including,
but not limited to, rolling stock, shops, garages and
terminals, and any other property or facilities of a
private carrier used or useful in the operation of
transit service in the District. Any condemnation
proceedings shall be instituted and maintained in the
name of the Authority and shall otherwise be governed by
the provisions of Title 12 of THE REAL PROPERTY Article
[21] of [this] THE Code.

SECTION 9. AND BE IT FURTHER ENACTED, That Section
51 of Article 77 — Public Education, of the Annotated
Code of Maryland (1969 Replacement Volume and 1973
Supplement) be and it is hereby repealed and re—enacted,
with amendments, to read as follows:
