SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 5-1220 to 5-1222, inclusive,
to be under the new Subheading "Part III. Nature
Conservancy" be and they are hereby added to Article -
Natural Resources, of the Annotated Code of Maryland
(1973 Volume) to read as follows:
Article — Natural Resources
PART III. NATURE CONSERVANCY.
5-1220. PROPOSAL BY NATURE CONSERVANCY.
THE NATURE CONSERVANCY MAY SUBMIT TO THE DEPARTMENT
A PROPOSAL OUTLINING AN AREA IN WHICH THE NATURE
CONSERVANCY HAS SECURED OR IS CONSIDERING SECURING TITLE
OR OTHER LEGAL INTEREST. THE PROPOSAL SHALL INCLUDE THE
LOCATION, ACREAGE, EXPLANATION OF PLANNED USE, AND
EXPLANATION OF VALUES WHICH MAKE THE ACREAGE OF INTEREST
TO THE STATE.
5-1221. ACTION BY SECRETARY.
WITHIN THREE MONTHS AFTER RECEIPT OF THE PROPOSAL,
THE SECRETARY SHALL REPORT TO THE NATURE CONSERVANCY HIS
RECOMMENDATIONS AS TO THE SUITABILITY OR NONSUITABILITY
OF THE PROPOSAL IN RELATION TO THE STATE'S PROGRAM OF
OPEN SPACE OR WILDLAND AREAS, WITH COPIES TO THE
[[GOVERNOR]] BOARD OF PUBLIC WORKS, THE PRESIDENT OF THE
SENATE, AND THE SPEAKER OF THE HOUSE OF DELEGATES.
5-1222. AGREEMENTS BY SECRETARY.
NOTWITHSTANDING THE PROVISIONS OF ARTICLE 78A, SEC.
19A OF THIS CODE, SUBJECT TO THE AVAILABILITY OF FUNDS
AND IN ACCORDANCE WITH OTHER PROVISIONS OF THIS ARTICLE
REGARDING OPEN SPACE AND WILDLAND AREAS, THE SECRETARY
SAY ENTER INTO AGREEMENTS WITH THE NATURE CONSERVANCY FOR
THE STATE TO ACQUIRE TITLE TO OR AN INTEREST IN PROPERTY
OWNED BY THE NATURE CONSERVANCY OR PROPERTY ON WHICH THE
NATURE CONSERVANCY HOLDS AN OPTION OR A CONTRACT TO
PURCHASE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
