CHAPTER 34
(House Bill 504)

AN ACT to repeal and re-enact, with amendments, Section 90(b)(2) of Article 2B
of the Annotated Code of Maryland (1972 Supplement), title "Alcoholic
Beverages," subtitle "Hours and Days for Sale," to provide that a certain class
of license holders of beer, and beer and light wine in Washington County be
permitted to sell alcoholic beverages on Sunday.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 90(b)(2) of Article 2B of the Annotated Code of
Maryland (1972 Supplement), title "Alcoholic Beverages," subtitle "Hours and
Days for Sale," be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

90(b)

(2) This subsection shall be applicable and have effect in Caroline, Cecil,
Dorchester, Garrett, except as provided in (5) of this subsection, Harford, Kent,
Queen Anne's, Somerset, Talbot, Washington, Wicomico, (except as provided in
(6) of this subsection) and Worcester (except as otherwise provided herein)
counties, provided that it shall not apply to or affect special Class C licenses issued
under the provisions of this article, nor shall it apply to special Class C licenses
issued in Washington County for temporary use. Nothing in this section shall
require the holder of any Class A (off-sale) beer license in Washington County to
close his place of business on Sunday provided such licensee shall close that part of
his place of business from which beer is sold. Nothing in this section shall apply to
any Class B beer, BEER AND LIGHT WINE OR BEER, wine and liquor license
(on-sale) hotel and restaurant in Washington County whose total food sales
comprise at least 65% of its total sales volume, nor to any class C beer, wine and
liquor license (on-sale) club in Washington County, and under either of such class
of licenses it shall be lawful to keep for sale and to sell in Washington County for
consumption on the licensed premises, with meals only, alcoholic beverages on
Sundays between the hours of 12 noon and 9 o'clock p.m. Licensees selling
alcoholic beverages on Sunday shall pay an annual fee of two hundred fifty dollars
($250.00) in addition to their annual license fee. Nothing in this section shall apply
to any Class C beer, wine and liquor license (on-sale) club in Kent County under
which it shall be lawful to keep for sale and sell for consumption on the licensed
premises alcoholic beverages on Sunday between the hours of 2:00 o'clock p.m.
and midnight. Nothing in this section shall apply to holders of "special Sunday
licenses" issued in Queen Anne's County pursuant to Section 103A.
Notwithstanding the other provisions of this article, it is lawful for Class A beer
licensees in Caroline County to sell alcoholic beverages between the hours of 12
o'clock noon and 12 o'clock midnight on Sunday, and for Class C "clubs," beer,
wine and liquor licensees in Caroline County to sell alcoholic beverages between
the hours of 12 o'clock midnight and 2 o'clock a.m. and between 12 o'clock noon
and 12 o'clock midnight on Sunday. Notwithstanding the other provisions of this
section and Section 95B of this article, in Cecil County it is lawful for Class C
(on-sale) (clubs) beer, beer and light wine, or beer, wine and liquor licensees to
permit the use and consumption of alcoholic beverages between the hours of 1
o'clock p.m. and 7 o'clock p.m. on Sunday, and it is lawful for all classes of
