APPEALS OF MARYLAND. THE HEARING EXAMINER SHALL
SUBMIT A TRANSCRIPT OF THE PROCEEDINGS AND EXHIBITS, HIS
FINDINGS OF FACT AND CONCLUSIONS OF LAW, AND HIS
RECOMMENDATIONS TO THE BOARD OF EDUCATION AND THE
APPELLANT(S). THE BOARD SHALL ALLOW PARTIES TO THE
PROCEEDINGS BEFORE THE HEARING [[EXAMINERS]] EXAMINER
AN OPPORTUNITY TO MAKE ARGUMENTS BEFORE IT, IF DESIRED.
FOLLOWING A REVIEW OF THE RECORD AND THE
RECOMMENDATIONS, THE BOARD SHALL RENDER A DECISION,
WHICH DECISION SHALL BE SUBJECT TO FURTHER APPEAL TO THE
STATE BOARD OF EDUCATION AS OTHERWISE PROVIDED IN THIS
ARTICLE. THE BOARD OF EDUCATION OF MONTGOMERY COUNTY
SHALL ADOPT REASONABLE RULES AND REGULATIONS TO
GOVERN THE CONDUCT OF PROCEEDINGS BEFORE THE HEARING
EXAMINER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

(House Bill 371)

AN ACT to repeal and re-enact, with amendments, Section 64-4(b) of the Code of
Public Local Laws of Montgomery County (1965 Edition, being Article 16 of
the Code of Public Local Laws of Maryland), title "Montgomery County,"
subtitle "Title III. City, Town and Village Laws," subheading "Subtitle 3.
Villages," removing a certain voting qualification in the election to fill certain
vacancies in Chevy Chase View.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 64-4(b) of the Code of Public Local Laws of
Montgomery County (1965 Edition, being Article 16 of the Code of Public Local
Laws of Maryland), title "Montgomery County," subtitle "Title III. City, Town
and Village Laws," subheading "Subtitle 3. Villages," be and it is hereby repealed
and re-enacted, with amendments, to read as follows:

64-4.                                                                                                                                                       

(b) On May 1, 1951, and on the second Tuesday in May of each succeeding
year, an election shall be held at which councilmen and a secretary-treasurer shall
be elected to fill any vacancies which may have occurred during the previous year;
provided, however, that councilmen elected to fill vacancies shall be elected only to
serve for the remainder of the unexpired term. Elections shall be by ballot in a
manner to be prescribed by the council. Only [resident real property owners of
legal age or] registered and qualified voters of Montgomery County residing in
Chevy Chase View shall be entitled to vote.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
