SECTION 2. AND BE IT FURTHER ENACTED, That the provisions of this
Act relating to the county surveyor shall become effective at the end of the term of
the surveyor presently in office.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

AN ACT to repeal and re-enact, with amendments, Section 8-6 of the Code of
Public Local Laws of Frederick County (1959 Edition, being Article 11 of the
Code of Public Local Laws of Maryland), title "Frederick County," subtitle
"Finance and Taxation," subheading "In General," and to enact a new Section
8-11 to the Code of Public Local Laws of Frederick County (1959 Edition,
being Article 11 of the Code of Public Local Laws of Maryland), title
"Frederick County," subtitle "Finance and Taxation," subheading "In
General," to follow immediately after Section 8-10 thereof, to provide that the
County Commissioners may expend special revenues received by the county as a
result of federal or state grants, even though the grant may be received
subsequent to the adoption of the county budget.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 8-6 of the Code of Public Local Laws of Frederick
County (1959 Edition, being Article 11 of the Code of Public Local Laws of
Maryland), title "Frederick County," subtitle "Finance and Taxation," subheading
"In General," be and it is hereby repealed and re-enacted, with amendments, and
that new Section 8-11 be and it is hereby added to the same Code, title, subtitle
and subheading, to follow immediately after Section 8-10 thereof, and all to read
as follows:
8-6.
The revenue derived by the county from all sources shall be devoted absolutely
to paying and defraying the estimates of the board of estimates in detail by line
item as approved in the annual budget. However, to serve the best interests of the
county throughout the fiscal year, the board of county commissioners may make
such line item transfers as it deems necessary provided such transfers are approved
in writing; no excess of income over the total of estimates, plus the unexpended
balance of the emergency fund, shall be added to any estimate or be used for any
purpose, except as a part of the surplus to be carried over to the ensuing fiscal
year as provided by section 8-19. NOTHING IN THIS SECTION SHALL
AFFECT SPECIAL REVENUES RECEIVED BY THE COUNTY AS
PROVIDED FOR IN SECTION 8-11.
8-11.
THE COUNTY COMMISSIONERS MAY EXPEND SUCH SPECIAL
REVENUES, RECEIVED BY THE COUNTY AS THE RESULT OF STATE
OR FEDERAL LEGISLATION OR GRANTS, WITHIN THE PROVISIONS
OF SAID SPECIAL REVENUE LEGISLATION OR GRANT EVEN
THOUGH RECEIVED SUBSEQUENT TO ADOPTION OF THE BUDGET.
