Ch. 626                             MARVIN MANDEL, Governor                                1277

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 11-105(a) of Article 21 of the Annotated Code of
Maryland (1972 Interim Supplement), "Real Property." title "Horizontal Property
Act," be and it is hereby repealed and re-enacted, with amendments, to read as
follows:

11-105.

(a) A condominium unit owner shall have the exclusive fee-simple OR
LEASEHOLD ownership of his unit and shall have a common right to a share,
with the other coowners, of an undivided [fee-simple] interest in the common
elements of the property, equivalent to the percentage representing the value of his
unit to the value of the whole property. Said percentage interest shall not be
separated from the unit to which it appertains.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 626
(House Bill 1340)

AN ACT to add new Section 261C to Article 27 of the Annotated Code of
Maryland (1971 Replacement Volume and 1972 Supplement), title "Crimes and
Punishments," subtitle "Gaming," to follow immediately after Section 261B
thereof, to permit political organizations [[to acquire permits to conduct
raffles, bingos, carnivals and bazaars in Baltimore City where such permits are
issued to other organizations.]] to award certain prizes at fund raising affairs in
Baltimore City.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 261C be and it is hereby added to Article 27 of
the Annotated Code of Maryland (1971 Replacement Volume and 1972
Supplement), title "Crimes and Punishments," subtitle "Gaming," to follow
immediately after Section 261B thereof and to read as follows:

261C.

(A)    NOTWITHSTANDING ANY OTHER PROVISIONS OF THIS
ARTICLE, ANY BONA FIDE POLITICALLY PARTISAN
ORGANIZATION AS DEFINED IN ARTICLE 33 OF THIS CODE MAY
CONDUCT FUND RAISING AFFAIRS AT WHICH [[ ACQUIRE A
NON-TRANSFERABLE PERMIT TO CONDUCT A BINGO, RAFFLE,
CARNIVAL OR BAZAAR IN BALTIMORE CITY WHERE SUCH
ACTIVITIES MAY BE CONDUCTED BY OTHER ORGANIZATIONS.

(B)  THE PERMIT OR LICENSE SHALL BE ISSUED BY THE PERSON
OR AGENCY AUTHORIZED TO ISSUE SUCH PERMITS OR LICENSES.

(C)     WITH RESPECT TO BINGOS OR RAFFLES CONDUCTED
PURSUANT TO THIS SECTION, MERCHANDISE OR CASH PRIZES
MAY BE AWARDED.
