CHAPTER 624
(House Bill 1324)

AN ACT to repeal Section 218 of Article 93A of the Annotated Code of
Maryland (1969 Replacement Volume), title "Protection of Minors and Other
Persons Under Disability," subtitle "Protection of Property of Minors and
Disabled Persons," and to enact new Section 218 in lieu thereof, to stand in the
place of the Section repealed, amending the law with respect to compensation of
guardians to provide that, except in unusual circumstances, guardians shall be
entitled to the same compensation as trustees.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 218 of Article 93A of the Annotated Code of
Maryland (1969 Replacement Volume), title "Protection of Minors and Other
Persons Under Disability," subtitle "Protection of Property of Minors and
Disabled Persons," be and it is hereby repealed, and that new Section 218 be and
it is hereby enacted in lieu thereof, to stand in the place of the Section so repealed,
and to read as follows:

218.

[The court shall allow reasonable compensation, in relation to the time and
effort expended by the guardian, from the estate to any guardian who has not
waived his right to compensation. A guardian is entitled to be reimbursed from the
estate for his actual and necessary expenses in managing the estate.]

EXCEPT IN UNUSUAL CIRCUMSTANCES, THE GUARDIAN SHALL
BE ENTITLED TO THE SAME COMPENSATION AND
REIMBURSEMENT FOR ACTUAL AND NECESSARY EXPENSES AS
THE TRUSTEE OF A TRUST, AND NO PETITION OR HEARING SHALL
BE REQUIRED TO ENABLE THE GUARDIAN TO BE ENTITLED TO
SUCH COMPENSATION AND EXPENSES. UPON THE PETITION OF
ANY INTERESTED PERSON, AND UPON A FINDING BY THE COURT
THAT UNUSUAL CIRCUMSTANCES EXIST, THE COURT MAY
INCREASE OR DECREASE SUCH COMPENSATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 625
(House Bill 1331)

AN ACT to repeal and re-enact, with amendments, Section 11-105(a) of Article 21
of the Annotated Code of Maryland (1972 Interim Supplement), "Real
Property," title "Horizontal Property Act," to [[correct an error in the
Horizontal Property Act.]] provide that a condominium unit owner has the
right to leasehold ownership of his unit, as well as fee-simple ownership, and has
a common right to a share of an undivided leasehold interest, as well as an
undivided fee-simple interest in the common elements of the property.
