Section 4. And be it further enacted, That Section 13-300.2 (65)
of said Code, Title and Subtitle, Article I, "General Provisions and
Definitions", as added by Bill No. 8-71, be and it is hereby repealed,

and Section 13-321.6 of said Code, Title, and Subtitle, Article VI,

"Special Districts", Heading, "TC—Town Center Zones", as added
by Bill No. 38-70, be and it is hereby repealed and re-enacted, with
amendments, to read as
follows:.

SECTION 4A. AND BE IT FURTHER ENACTED, THAT
SECTION 13-321.6 OF SAID CODE, TITLE AND SUBTITLE,
ARTICLE VI, "SPECIAL DISTRICTS", HEADING, "TC—TOWN
CENTER ZONES", AS ADDED BY BILL NO. 38-70, BE AND IT
IS HEREBY REPEALED AND RE-ENACTED, WITH AMEND-
MENTS, TO READ AS FOLLOWS:

Section 13-321.6.

(a)    Each structure having a multi-family residential use shall
provide a minimum open space ratio of 0.3 for residential uses in
excess of any grade level parking court. As used in this Subsection,
residential
[Residential] open space means open area used in common
by residents of a development, and
shall include any non-public open
ground area with less than fifty percent (50%) covered space, and
any open roof or floor area used as common residential recreation
areas.

(b)    Any structure more than four (4) stories high shall pro-
vide a minimum open space ratio of 0.3, with a yard measuring not
less than twenty-five feet (25') on any side not facing a public street.
As used in this subsection, "open space" means any unenclosed roof or
ground surface (not including parking areas), paved or unpaved, less
than fifty percent (50%) covered, and accessible to the public
twenty-four (24) hours per day.
