2536 County Local Laws
Section 1. Be it enacted by the County Council of Anne Arundel
County, Maryland, That Sections 13-318 (a), (b) (2) and (3), (c),
(d) and (e) of the Anne Arundel County Code (1967 Edition and
Supplements), Title 13, "Planning and Zoning", Subtitle 3, "Zon-
ing Regulations", Article VI, "Special Districts", Heading, "OS-Open
Space Districts", as enacted by Bill No. 53-70, be and they are hereby
repealed and re-enacted, with amendments, respectively, to read as
follows:
Section 13-318.
(a) Open space districts shall preserve open areas for recrea-
tional uses, protect persons and property against hazards of floods
and water pollution, and protect the County against the costs
which may be incurred resulting when development which is not
compatible with the natural environment occurs. Such districts shall
guide, define and protect development, communities and land uses and
environmental study areas, through proper location of open space
areas.
Section 13-318 (b).
(2) All Private and public lands used or proposed to be used
for passive and active recreation at a subdivision, community or
regional level.
(3) All Lands designated as structural open space in the Anne
Arundel County General Development Plan or detail Plan of Open
Space.

(c) For purposes of this heading:
[(1) "Coastal floodplain" means coastal wetlands, tidal
marshes and contiguous uplands which are inundated regularly or
intermittently from normal tidal cycles and/or peak-lunar and storm
tides. The upland limit of peak storm tide (and the limit of the
coastal floodplain) shall be established at the upland United States
Coastal Geodetic Survey contour representing the local maximum
flood of record of maximum historical flood.]
[(2)] (1) "Community Recreation" shall include recreation
facilities used primarily by people living in large geographical areas
of the County.
[(3)] (2) "Floodplain" means that area which would be
inundated by storm water runoff, equivalent to that which would
occur from a rainfall of fifty (50) year frequency after total de-
velopment of the watershed; said area defined by an elevation plus
one foot (1') below which no development may take place.
[(4)] (3) "Natural Drainage System" shall consist of upland,
floodplain lands, and water courses, including coastal wetlands. Such
lands and waters may include but not be limited to all uplands
exhibiting fifteen percent (15%) or greater slopes, all fresh, salt or
