635 Acknowledged the within Instrument of Writing to be their Act and Deed respectively and the Lands and premisses in the same particularly specified to be the Right and Estate of the within John Booth his Heirs and Assigns for ever according to the true intent and meaning thereof And the same Winifred Greenwell being by me privately examined out of the hearing of her Husband declared that she made her acknowledgement of the same willingly and freely and without being Induced thereto by fear or threats of or Ill usuage by her husband or fear of his displeasure Geo Steuart 12 sides Recorded 17.th Sept.r 1765 Ex.d This Indenture made this Tenth day of September Anno Domini Seventeen Hundred and sixty five Witnesseth that Whereas Brice Thomas Beal Worthington Passed his Bond to a Certain George Scott of Frederick County bearing date the Fourteenth day of August Seventeen Hundred and fifty Six the Condition of Which is as follows That if the above Bound Brice Tho.s Beal Worthington his Heirs Executors or Administrators shall well and Truly sign and Acknowledge a Deed of Bargain and Sale Provided his Lordships Patent of Confirmation be Granted unto the said Brice Tho.s Beale Worthington his Heirs and Assigns on a Certificate of Resurvey on a Tract of land called Seths Folly lying in Frederick County now Containing as p Certificate thereof Eleven Hundred and ten acres and Assigned by the said George Scott unto the said Brice Tho.s Beale Worthington his heirs and Assigns for ever as by the said Certificate Referrence thereto being had may more fully Appear the said Deed of Bargain and Sale to be Procured at the Expence of the said George Scott his Heirs or Assigns and to be for Five Hundred and Thirty Acres part of the Resurveyd land aforesaid if none of the land aforesaid if none of the Land Remaining to the said Brice Tho.s Beal Worthington his heirs or Assignes lies in Elder Surveyes the said land to be laid out adjoining the said Scotts Dwelling House unto him the said George Scott his Heirs or Assigns Provided the sum of Twenty three Pounds Ten Shillings Sterling Money be paid unto the said Brice Tho.s Beal Worthington his Heirs Executors Admin.rs or Assigns on or before the Twentieth day of August next Ensuing as also the Quit Rents now due & shall hereafter be due to the Lord Proprietary on the five Hundred and Thirty acres aforesaid and all the Charge arising on making and Patenting the said survey the said Deed to Contain no other Warrantie than from the said Brice Tho.s Beale Worthington and his Heirs and all Persons Claiming any Right or title thereto by or under him the said Brice Thomas Beal Worthington or his Heirs but no further or other Warrantie or Assureance to be Contained in the said Deed of Bargain and sale that being the Agreement and so to be Performed by the said Brice Tho.s Beal Worthington which if Complyed with or Tenderd so to be by the said Brice Tho.s Beal Worthington or his Heirs that then this obligation to be void Else to be and Remain in full force and virtue in Law And Whereas the said George Scott is since deceased without Complying with the Condition |
