626 how^so^ever in said William's Behalf he the s.d William shall and will at all any times hereafter well and truly indemnify acquit save harmless or otherwise duly secure And Moreover that he the said William shall and will ^well^ and truly Comply with and perform all & Singular the Covenants & Agreements entered into by him in Behalf of His sureties af.d and particularlized in the Instrument of Writing Executed by him as afs.d and above referred to And also That he will pay and satisfy as above mentioned the Consideration Money of these Presents being five Shillings Currency with the Cost and Charge of Writing & recording the same And that upon his Default herein or any Part thereof (In Case the s.d John & Denton Hammond or either of them their respective Heirs &C do or may or shall sustain any Inconvenience Loss or Damage in any wise howsoever by their being or becoming Sureties for s.d William in the Injunction Bond af.d so Executed by him them as af.d) It shall and may be lawfull to and for the s.d John & Denton Hammond and they and each respective Heirs Ex.rs &C are hereby fully authorised & ^Improved^ Imprisoned to seize take and Expose to publick Vendue or as the ^retain^ upon just & fair Appraisement thereof had all Every or any part or Parcell of the Premises real & Personal with their Appurtenances herein above mentioned, referred to, comprehended in otherwise intended to be included herein and disposed of by s.d William or all or any other of Estate real or personal of said William Gaither & whereof he is seised and possessed tho herein the same be not Enumerated or particularized, tow.ds satisfying & repairing (as far as the value thereof may Extend) such Inconvenience, Loss Damage &C; as by his Sureties John & Denton Hammond af.d in such Quality & in his Behalf may or shall be sustained or Suffered by them In Witness Whereof the s.d William Gaither hath hereunto set his Hand & Seal the Day and Year first above written, Signed sealed & W.m Gaither delivered before us Jn.o Ijams Th.s Watkins On the Back of the aforegoing Mortgage was thus Written Viz Rece.d this Fifth day of April 1765 the Consideration Money within Mentioned Expressed to be paid me by John & Denton Hammond being the sum of five Shillings Currency, by me Jn.o Ijams W.m Gaither seal TWatkins April 5.th 1765 Then came William Gaither Party to the Within Deed and Acknowledged the same to be his Act & Deed and hte Premisses real and Personal with their Appurtenances within Contained & comprehended or intended so to be, and therein disposed of by him to (be) |
