543 On on Petapsco Main Falls near Elk Ridge Landing which had before been agreed to be built by the said Benjamin Tasker Junior Charles Carroll Esquire Charles Carroll Barrister Charles Carroll son of Daniel Daniel Dulany and Walter Dulany in the proportions aforesaid and there have been also some purchases of Lands made Convenient and for the use of the Iron Works aforesaid since the Death of the said Benjamin Tasker Junior the legal Estate in whose share hath been vested in the said Benjamin Tasker Esquire or if the Legal Estate hath not been Conveyed his Name hath been inserted in the Contracts therefor And whereas the said Benjamin Tasker Party hereto on the thirteenth day of March last past at the House of William Reynolds in Annapolis after advertising the same in the Maryland Gazette for Six Weeks successively did set up and Expose to publick sale by way of Vendue the said Benjamin Tasker Junior his one undivided fifth part or Share of the said Furnace three Forges and Lands Servants Negroes Horses Cattle and Stock and all his the said Benjamin Tasker Junior his share proportion and Interest legal and equitable in the said Iron Works Lands and Stock thereto belonging; At which Vendue the aforesaid Joseph Galloway was the best and highest bidder at and for the sum and price of Five thousand and two hundred pounds sterling Money Now this Indenture witnesseth that the said Benjamin Tasker party hereto by virtue of the Testament and last will aforesaid in Consideration of the Premisses and of the said sum of Five thousand and two hundred pounds sterling Money to him in hand paid by the said Joseph Galloway at or before the sealing and delivery of these Presents the Receipt whereof the said Joseph Galloway his Heirs Executors Administrators and Assigns and every of them by these Presents Hath given granted bargained sold aliened released enfeoffed and confirmed And by these Presents Doth give Grant bargain sell alien release enfeoff and Confirm unto him the said Joseph Galloway his Heirs and Assigns one undivided fifth part of all and each and every the said Iron Furnace and three Forges and also the said Benjamin Tasker Junior deceased his one undivided fifth part of all and every the Lands Tennements and Hereditaments held in Common in his Life time with the said Charles Carroll Esquire Charles Carroll Barrister Charles Carroll son of Daniel Daniel Dulany and Walter Dulany or any or either of them And also his the said Benjamin Tasker party hereto his undivided fifth part of all and every Lands Tenements and Hereditaments by him now held in Common or Jointenancy with the said Charles Carroll Esquire Charles Carroll Barrister Charles Carroll son of Daniel Daniel Dulany and Walter Dulany or any or either of them together with all Houses Edifices Buildings Gardens Orchards Ways Waters Watercourses Woods underwoods Easements Priviledges Improvem.ts Advantages and Appurtenances whatsoever to the said Premisses belonging or in any wise appertaining And the Reversion and Reversions Remainder and Remainders and Remainders Rents Issues and Profitts thereof and all the Estate Right Title Interest use Trust Possession Property Claim and Demand both in Law and Equity of them the said Benjamin Tasker Junior and Benjamin Tasker part hereto and each of them of into or out of the same And the said Benjamin Tasker party hereto for the Consideration aforesaid Hath also Granted sold and Delivered And by these Presents |
