127. according to the true Intent and Meaning of these Presents and untill such sale and disposal of the said Premisses aforesaid shall be had or made in pursuance of these Presents or the trusts hereby Created It shall and may be Lawfull to and for the said John Buchanan his heirs Executors Administrators and Assigns from Time to Time to pay apply and dispose of the Rents Issues and Profits of the said Premisses as the same shall accrue due and be received upon the Trusts and to and for the Uses and Purposes herein before mentioned and expressed of and concerning the Monies N.o 4 W.m Hippisley To arise by sale & Disposition of the said Premisses And the said James Wardrop for himself his Heirs Executors & Administrators doth hereby further Covenant Promise & agree to and with the said John Buchanan his Heirs Executors Administrators & Assigns That he the said James Wardrop for and Notwithstanding any Act Matter or thing whatsoever by him done Comitted Omitted or Suffered Now hath in himself good Right full Power and lawfull Authority to grant Release Assign & Convey all and every the Premisses with their Appurtenances hereby or herein before mentioned and intended to be hereby granted released Assigned & Conveyed unto the said John Buchanan his Heirs Executors Administrators & Assigns respectively in manner aforesaid & according to the true intent & Meaning of these Presents And that for and Notwithstanding any such Act Matter or thing as aforesaid) the said John Buchanan his heirs Executors Administrators and Assigns respectively shall or lawfully may from and after default made by the Said James Wardrop his Heirs Executors or Administrators contrary to the true Intent and meaning of these Presents in Payment of the said several sums of of Five thousand one hundred and Eighty Pounds Six shillings and seven Pence with Interest aforesaid and one thousand fifty Eight Pounds Eighteen shillings to the said John Buchanan and James Johnson respectively or their respective Executors Administrators or Assigns or shuch other sum of sums of Money as the said James Wardrop his heirs Executors or Administrators shall on the said second day of August which will be in the Year of our Lord One thousand seven hundred and Fifty six be justly and truly indebted to the said John Buchanan & James Johnson respectively their respective Executors Administrators and Assigns peaceably and quietly to Have hold and Occupy |
