Ex.d This Indenture Tripartite made this thirteenth day of
       April in the Year of our Lord Seventeen hundred and fifty Nine Between
       Francis Chew of Ann Arundel County Gentleman of the first part John
       Smith of Calvert County Gentleman Sheriff of the same County of the second
       Part and Thomas Johnson Junior of the third Part Whereas at a Provincial
       Court held at the City of Annapolis the Second Tuesday of April Instant the
       aforesaid Thomas Johnson by a Writ of Entry Sur Disseisin en le post did
       demand against the aforesaid John Smith All that Parcel of Land situate
       lying and being in Calvert County aforesaid being Part of a Tract of Land
       called and known by the name of Dowsdail circumscribed by the following
       Courses Boundaries and Distances that is to say Beginning at a Beach
       Tree Standing in a Branch of Abingtons Creek and then running from
       thence South and by East One hundred and Sixty four Perches then East three
       hundred Eighty three Perches then North fifteen Degrees West Two hundred
       and Two Perches to a bounded Post then with a Streight Line to the first
       Beginning containing four hundred Acres with the Appurtenances
       unto and upon which Said Writ of Entry the aforesaid John Smith at
       the same Term did appear and did vouch to Warranty thereof the afsd
       Francis Chew who also forthwith at the Same Term did appear and did
       enter into the Warranty of the same and afterward upon the same Writ
       did vouch the Common Vouchee to Warrant the Premisses so demanded
       who forthwith appeared and did enter into the Warranty of the Same and
       afterwards made Default whereby a Common Recovery of the Premisses
       with the Appurtenances was had and perfected as by the Record thereof
       in the said Provincial Court remaining may more at Large appear Now
       this Indenture Witnesseth that it is covenanted granted and
       agreed upon by and between the Said Parties to these presents and the
       said Francis Chew and Thomas Johnson for them Selves severally and
       apart and for their Several Heirs Executors and Administrators do hereby
       Covenant grant and agree to and with the said John Smith his Heirs
                                                                                        (Executors)
